About additional measures for further expansion of access to justice and increase in efficiency of activity of the courts

The judicial and legal reforms performed in recent years along with ensuring independence of judicial authority, openness and transparency of courts gave opportunity of strengthening of guarantees of protection of the rights and legitimate interests of citizens and entrepreneurs.

At the same time further expansion of access of the population to justice within the principle "New Uzbekistan - new court" requires acceleration of reforming of judicial system of law, implementation of the advanced international standards to the sphere.

According to the tasks determined in the Strategy of development for new Uzbekistan for 2022 - 2026 and also for the purpose of ensuring authentic independence of judicial authority, increase in efficiency of activity of the courts and quality of administration of law:

1. Approve the short-term Strategy of raising on qualitatively new level of judicial system for 2023 - 2026 (further - Strategy) according to appendix No. 1.

Within Strategy by priority tasks of ensuring justice to determine:

forming of authentic fair judicial system on the basis of the idea "For honor and advantage of the person" and the direction it activities on effective protection of interests of the people and advantage of the person.

enforcement of trust of the people, including entrepreneurs, to judicial system by achievement of adoption of fair judgments, approval in creation of each citizen of image of court and judges as the reliable defenders;

enhancement of the legislation directed to creation of all opportunities for citizens and entrepreneurs on protection of the rights and legitimate interests in courts, complete realization of the principles of competitiveness and equality of the parties in legal proceedings, ensuring objectivity of courts in practice;

complete digitalization of activity of the courts, implementation of technologies of artificial intelligence, improvement of interdepartmental exchange of electronic data, expansion of opportunities of remote participation in judicial sessions;

strengthening of guarantees of independence and immunity of judges, development of effective mechanisms of the prevention of cases of disrespect for court and interventions in legal cases;

ensuring strict execution of judgments, increase in responsibility of state bodies and local khokimiyats in this direction;

forming at each citizen and the entrepreneur who took a legal action, feelings of satisfaction with court, and finally - the state, way of instilling of high culture of communication in judges and employees of courts.

2. Approve the Action program on realization of short-term Strategy of raising on qualitatively new level of judicial system for 2023 - 2026 (further - the Action program) according to appendix No. 2.

Assign to the Supreme Court (B. Islamov), the Supreme judicial council (H. Yodgorov), the Attorney-General (N. Yuldoshev), and also heads of the responsible ministries and departments the personal responsibility for timely and complete execution of the actions provided by the Action program.

3. Take into consideration that by the Supreme Court jointly with Service of state security, the Prosecutor General's Office and the Ministry of Justice for the purpose of creation of the convenient and simplified for citizens procedure for test of legality, justification and justice of adoption of judgments on criminal cases the bill providing is drafted:

review of the cases considered by interdistrict, district, city courts in the first instance, in the regional and equated to them courts in appeal or cassation procedure;

review of the cases considered by the regional and equated to them courts in appeal or cassation procedure in the same courts in auditing procedure;

review of the cases considered by the regional and equated to them courts in auditing procedure in judicial boards of the Supreme Court in auditing procedure;

cancellation of procedure for the direction by superior courts of cases on new trial in subordinate courts and assignment on superior courts of responsibility for removal of the final decision on case.

To the Supreme Court (B. Islamov) together with the interested ministries and departments to take the organizational measures necessary for timely and effective implementation in practice of the offered new procedure, and also detailed explanation to the population of its essence and content.

4. Note that for the purpose of ensuring authentic independence of judges with the state all conditions for stiff punishment for any intervention in activities of judges, their safe work are created.

Determine the following measures for strengthening of independence of the courts and ensuring immunity of judges:
