About approval of the Regulations on the Register of exchange bureaus of foreign currency and modification of some regulatory legal acts of the National Bank of Ukraine

According to Articles 7, of 15, of 44, of 55, 55-1, 56 of the Law of Ukraine "About the National Bank of Ukraine", article 66 of the Law "About Banks and Banking Activity", article 7 of the Law of Ukraine "About financial services and state regulation of the markets of financial services", Articles 5, of 6, 9 Laws of Ukraine "About currency and currency transactions", the Tax code of Ukraine, for the purpose of determination of procedure for maintaining the Register of exchange bureaus of foreign currency the Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on the Register of exchange bureaus of foreign currency (further - the Provision), it is applied.

2. Bring in the resolution of Board of the National Bank of Ukraine of July 29, 2022 No. 165 "About features of regulation and supervision of implementation of activities for trade in currency values in cash form during action of warlike situation and introduction of amendments to resolutions of Board of the National Bank of Ukraine of March 06, 2022 No. 39" the following changes:

The subitem 1 of Item 3 to state 1) in the following edition:

"To inform 1) on the established buying rates and sales of foreign currencies, on implementation of currency exchange transactions in any form out of cash desks of organization, its structural divisions, branches and other separate divisions, exchange bureaus of foreign currency, objects of mail service of organization in which activities for trade in currency values in cash form are performed (further - structural/separate divisions of organization), including on the special temporary and stationary designs located in buildings, constructions on the open area, on the external surfaces of houses, constructions, on elements of the street equipment, over the carriageway of streets and roads, including stender, the floor stand, the mobile stand of currency exchange, electronic (LED) board of currency exchange;";

About updating of the automated information system of maintaining the State register of banks to provide to banks within 10 working days after receipt of the notification with means of e-mail of the National Bank of Ukraine (further - National Bank) representation to National Bank through the automated information system of maintaining the State register of banks of up-to-date information about the isolated / structural divisions opened for the purpose of implementation of trade in currency values in cash form, information on which is subject to entering into the Register of exchange bureaus of foreign currency.

The National Bank places information on updating of the automated information system of maintaining the State register of banks on pages of official Internet representative office of National Bank in day of the direction to banks of the message means of e-mail of National Bank according to paragraph one of Item 5 of this resolution.

6. Banks before receipt of the notification of National Bank on updating of the automated information system of maintaining the State register of banks, to the 05th day of every month since February 01, 2023 submit information on the isolated / structural divisions opened for the purpose of implementation of trade in currency values in cash form, information on which is subject to entering into the register of exchange bureaus of foreign currency, as of 01 numbers of such month in form according to appendix to provision with observance of requirements of Items 13 and 14 of the Section III of Provisions for its registration and representation.

7. To provide to operators of mail service within 10 working days from the date of entry into force of this resolution representation to National Bank of information on the structural divisions, information on which is not subject to entering into the Register of exchange bureaus of foreign currency, according to requirements of Item 6 of the Section II of Provisions for form according to appendix to the Provision.

8. The National Bank in pursuance of requirements of Item 141.13.5 of the Tax code of Ukraine creates information as of January 01, 2023 on the isolated / structural divisions:

1) the non-bank financial institutions opened for the purpose of implementation of trade in currency values in cash form based on information on structural divisions which moved in National Bank according to requirements of the Section VIII of the Regulations on procedure for issue to non-bank financial institutions, to operators of mail service of licenses for implementation of currency transactions approved by the resolution of Board of the National Bank of Ukraine of August 09, 2002 No. 297, registered in the Ministry of Justice of Ukraine on August 29, 2002 for No. 712/7000 (in edition of the resolution of Board of the National Bank of Ukraine of December 21, 2017 No. 137) (with changes);

2) banks and the operators of mail service opened for the purpose of implementation of trade in currency values in cash form based on information provided on written requests of National Bank.

9. The resolution becomes effective since January 1, 2023.
