About entering of amendments into the Criminal code of the Republic of Armenia

Article 1. In article 77 of the Criminal code of the Republic of Armenia of May 5, 2021:
Heading after the word "cooperation" to add 1) with the words "or accelerated";
To add 2) with parts 4.1 and 4.2 of the following content:
"4.1. In case of application of the accelerated production punishment cannot exceed three quarters of the maximum size or term, the punishment prescribed for the most severe looking prescribed by the sanction of the relevant article of the Special part of this Code. If three quarters of the most stiff punishment turn out less minimum size or the term of the most severe looking of the punishment prescribed by the sanction of the relevant article of the Special part of this Code, then there cannot be less minimum size or term.
4.2. In case of application of the accelerated production on incomplete crimes the rule provided by part 4.1 of this Article is applied after application of rules of assignment of punishment, stipulated in Article 73 of this Code to incomplete crime. If by results of calculation the measure of punishment turns out less minimum size or the term of the most severe looking of the punishment prescribed by the sanction of the relevant article of the Special part of this Code using rules of assignment of punishment for incomplete crime, then the size or the penal got by results of calculation is appointed.";
Part 5 after the words "are not applicable" to add 3) with words ", except as in case of assignment of punishment in case of application of the accelerated production";
To add 4) with part 5.1 following of content:
"5.1. In case of application of the accelerated production in the conditions of the recurrence provided by part 3 of article 76 of this Code, the rules provided by part 4.1 of this Article are applied after application of rules of the assignment of punishment provided by part 3 of article 76 of this Code.";
