Chapter 1. General provisions

Article 1. Subject of regulation of this Federal Law

1. This Federal Law determines the legal basis of state regulation of activities for the organization and carrying out gamblings in the territory of the Russian Federation and restrictions of implementation of the this activities for the purpose of protection of morality, the rights and legitimate interests of citizens are set.

2. Operation of this Federal Law does not extend to activities for the organization and carrying out lotteries, and also to activities of the organizers of trade performing the activities according to the Federal Law "About the Organized Biddings".

Article 2. Legislation on state regulation of activities for the organization and carrying out gamblings

Legal regulation of activities for the organization and carrying out gamblings is performed according to the Civil code of the Russian Federation, this Federal Law, other Federal Laws, the laws of subjects of the Russian Federation, and also can be performed by other regulatory legal acts accepted according to this Federal Law.

Article 3. State regulation of activities for the organization and carrying out gamblings

1. State regulation of activities for the organization and carrying out gamblings is performed in the way:

1) establishments of procedure of activities for the organization and carrying out gamblings and the corresponding restrictions, mandatory requirements to organizers of gamblings, gambling institutions, visitors of gambling institutions, gambling zones;

2) allocations of the territories intended for implementation of activities for the organization and carrying out gamblings - gambling zones;

3) issues of operating authorities on the organization and carrying out gamblings in gambling zones;

4) provisions of licenses for activities on the organization and carrying out gamblings in bookmaker offices or totalizators;

5) implementation of the state control (supervision) of the organization and carrying out gamblings directed to the warning, identification and suppression of violations of the law of state regulation of activities for the organization and carrying out gamblings by persons performing the specified activities.

2. State regulation of activities for the organization and carrying out gamblings according to this Federal Law is performed by the Government of the Russian Federation, federal executive body authorized by the Government of the Russian Federation on implementation of functions on normative legal regulation in the field of the organization and carrying out gamblings, other federal executive bodies of the Russian Federation within their competence, the public authorities of subjects of the Russian Federation authorized on implementation of functions on management of gambling zones.

Article 4. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) gambling - the agreement on prize based on risk signed by two or several participants of such agreement among themselves or with the organizer of gambling by the rules established by the organizer of gambling;

2) bet - the gambling in case of which the outcome of the agreement on prize based on risk signed by two or several participants of bet among themselves or with the organizer of this type of gambling depends on event concerning which it is unknown will come it or not;

3) rate - the money transferred by the participant of gambling to the organizer of gambling in cash form or with use of payment cards (except for the money transferred to the organizer of gamblings according to Item 3.1 of this Article) and the participations in gambling serving as condition according to the rules established by the organizer of gambling;

3. 1) interactive rate - money, including the electronic money transferred with use of electronic instruments of payment, including by means of information and telecommunication networks, including Internet network, and also means of communication, including means of mobile communication, the single center of accounting of transfers of rates of bookmaker offices and totalizators to the organizer of gamblings in bookmaker office or totalizator according to orders of participants of these types of gamblings and the participations in gambling serving as condition according to the rules established by such organizer of gamblings;

4) prize - money or other property, including the property rights which are subject to payment or transfer to the participant of gambling in case of approach of the result of gambling provided by the rules established by the organizer of gambling;

5) the organizer of gambling - the legal entity performing activities for the organization and carrying out gamblings;

6) activities for the organization and carrying out gamblings - activities for rendering services in the conclusion with participants of gamblings of the agreements on prize or on the organization of the conclusion of such agreements between two or several participants of gambling based on risk;

7) gambling zone - part of the territory of the Russian Federation which is intended for implementation of activities for the organization and carrying out gamblings and which border are established according to this Federal Law;

8) the operating authority on the organization and carrying out gamblings in gambling zone - the document issued according to this Federal Law granting to the organizer of gamblings the right to perform activities for the organization and carrying out gamblings in one gambling zone without restriction of quantity and type of gambling institutions;

9) license for activities on the organization and carrying out gamblings in bookmaker offices or totalizators - the special permission confirmed by entry in the register of licenses for activities on the organization and carrying out gamblings in bookmaker offices or totalizators (further - the register of licenses) and the right granting to the organizer of gamblings to perform activities for the organization and carrying out gamblings in bookmaker offices or totalizators out of gambling zones. In the register of licenses concerning each license for activities on the organization and carrying out gamblings in bookmaker offices or totalizators types of the rendered services (services in the conclusion with participants of gamblings of the agreements on prize based on risk or services in the organization of the conclusion of the agreements on prize between two or several participants of gambling based on risk), the locations of processing center of bookmaker office or totalizator or processing center of interactive rates of bookmaker office or totalizator, collection points for rates of bookmaker offices or totalizators, the domain name used for the sake of appearances the rendered service are surely specified;

10) the participant of gambling - the physical person which reached age of eighteen years, who is taking part in gambling and signing the agreement on prize with the organizer of gambling or other participant of gambling based on risk;

11) gambling institution - the building, structure, construction (the single isolated part of the building, structure, construction) in which activities for the organization and carrying out gamblings and rendering the services accompanying gamblings are performed only (including branch or other place of implementation of activities for the organization and carrying out gamblings and to rendering the services accompanying gamblings);

12) casino - gambling institution in which activities for the organization and carrying out gamblings with use of game tables or game tables and other gaming equipment provided by this Federal Law are performed;

13) the slot machine hall - gambling institution in which activities for the organization and carrying out gamblings with use of gaming machines or gaming machines and other gaming equipment provided by this Federal Law, except for game tables are performed;

14) bookmaker office - gambling institution in which the organizer of gamblings concludes bet with participants of this type of gamblings;

15) totalizator - gambling institution in which the organizer of gamblings will organize betting between participants of this type of gamblings, and also payment of prizes at the expense of the amount of the rates accepted from participants of this type of gamblings, less the size levied by the organizer of this type of gamblings of remuneration;

16) the gaming equipment - the devices or devices used for carrying out gamblings;

17) game table - the gaming equipment which represents the place with one or several game fields and by means of which the organizer of gamblings holds gamblings between their participants or acts as their participant through the workers;

18) the gaming machine - the gaming equipment (mechanical, electric, electronic or other technical equipment) used for carrying out gamblings with material prize which is determined in a random way, without participation of the organizer of gamblings or his workers, the device which is in the body of such gaming equipment or the program for electronic computers installed on the device which is in or out of the body of such gaming equipment;

19) cash desk of bookmaker office - part of collection point for rates of bookmaker office in which the organizer of gamblings accepts rates from participants of this type of gamblings except for of interactive rates, and pays prizes;

20) cash desk of totalizator - part of collection point for rates of totalizator in which the organizer of gamblings accepts rates from participants of this type of gamblings except for of interactive rates, and pays prizes;

21) cash desk of gambling institution - part of gambling institution in which the organizer of gamblings performs transactions with money and in which there is special equipment allowing to perform the specified transactions;

22) zone of servicing of participants of gamblings - part of gambling institution in which are installed the gaming equipment, cash desks of gambling institution, totalizator, bookmaker office, and also other equipment used by participants of gamblings;

23) office zone of gambling institution - the isolated part of gambling institution which is intended for workers of the organizer of gamblings and in which participants of gamblings are not allowed;

24) the services accompanying gamblings - hotel services, services of public catering, service in the field of spectacular and entertaining actions, services in distribution (realization, issue) of lottery tickets, lottery receipts, electronic lottery tickets, acceptance of lottery rates among participants of lottery, to payment, transfer or provision of prizes to participants of the international lotteries which are carried out based on international treaties of the Russian Federation, and the All-Russian state lotteries;

25) processing center of bookmaker office - part of gambling institution in which the organizer of gamblings carries out accounting and processing of the rates accepted from participants of this type of gamblings fixes results of gamblings, calculates the amounts of the prizes which are subject to payment, performs submission of information on the accepted rates and about the calculated prizes in collection points for rates of bookmaker office;

25. 1) processing center of interactive rates of bookmaker office - part of gambling institution in which the organizer of gamblings carries out accounting and processing of the rates accepted from participants of this type of gamblings concludes bet with participants of this type of gamblings in case of acceptance of interactive rates and carries out accounting and processing of the accepted interactive rates on the basis of information obtained from the single center of accounting of transfers of bookmaker offices and totalizators fixes results of gamblings, calculates the amounts of the prizes which are subject to payment, performs submission of information on the accepted rates, interactive rates and about the calculated prizes in collection points for rates of bookmaker office and in the single center of accounting of transfers of bookmaker offices and totalizators;

26) processing center of totalizator - part of gambling institution in which the organizer of gamblings carries out accounting and processing of the rates accepted from participants of this type of gamblings fixes results of gamblings, calculates the amounts of the prizes which are subject to payment, performs submission of information on the accepted rates and about the calculated prizes in collection points for rates of totalizator;

26. 1) processing center of interactive rates of totalizator - part of gambling institution in which the organizer of gamblings carries out accounting and processing of the rates accepted from participants of this type of gamblings will organize betting between participants of this type of gamblings in case of acceptance of interactive rates and carries out accounting and processing of the accepted interactive rates on the basis of information obtained from the single center of accounting of transfers of bookmaker offices and totalizators fixes results of gamblings, calculates the amounts of the prizes which are subject to payment, performs submission of information on the accepted rates, interactive rates and about the calculated prizes in collection points for rates of totalizator and in the single center of accounting of transfers of bookmaker offices and totalizators;
