Chapter 1. General provisions

Article 1. Subject of regulation of this Federal Law

1. This Federal Law governs the relations connected with the organization of the retail markets, the organization and implementation of sales activity of goods (performance of works, rendering services) in the retail markets and also the rights and obligations of persons performing the specified activities.

2. This Federal Law does not extend to the following types of activity:

1) sales activity of energy resources in the retail markets;

2) sales activity of goods (performance of works, rendering services) at the fairs organized outside the retail markets and having temporality. Requirements to the organization of fairs and sales of goods (performance of works, rendering services) on them are established by the Federal Law of December 28, 2009 N381-F3 "About Bases of State Regulation of Trading Activity in the Russian Federation".

3) activities for carrying out the organized biddings.

Article 2. Legal regulation of the relations connected with the organization of the retail markets, the organization and implementation of sales activity of goods (performance of works, rendering services) in the retail markets

Legal regulation of the relations connected with the organization of the retail markets, the organization and implementation of sales activity of goods (performance of works, rendering services) in the retail markets is performed by this Federal Law, other Federal Laws and other regulatory legal acts of the Russian Federation accepted according to them, and also the laws and other regulatory legal acts of subjects of the Russian Federation.

Article 3. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) sales activity of goods (performance of works, rendering services) in the retail market - the sales of goods, performance of works, rendering services performed respectively under the agreement of retail purchase and sale and the agreement of the consumer work;

2) the retail market (further - the market) - the property complex intended for implementation of sales activity of goods (performance of works, rendering services) on the basis of the agreements of retail purchase and sale and agreements of the consumer work of the prices which are freely determined directly in case of the conclusion and incorporating trade places. The markets are subdivided on universal and specialized;

3) the universal market - the retail market in which less than eighty percent of trade places from their total quantity are intended for implementation of sales of goods of one class determined according to the nomenclature of goods established by the federal executive body performing functions on development of state policy and normative legal regulation in the field of trade;

4) the specialized market - the retail market in which eighty and more percent of trade places from their total quantity are intended for implementation of sales of goods of one class determined according to the nomenclature of goods established by the federal executive body performing functions on development of state policy and normative legal regulation in the field of trade;

5) the agricultural market - the specialized market in which sale of agricultural products according to the list determined by the federal executive body authorized by the Government of the Russian Federation is performed;

6) the agricultural cooperative market - the agricultural market, control of which is exercised of the managing director of the market by the company registered in accordance with the legislation of the Russian Federation in the form of agricultural consumer cooperative and on which sale of agricultural products according to the list determined by the federal executive body authorized by the Government of the Russian Federation is performed;

7) the managing director of the market the company - the legal person who belongs the market which stays on the registry in tax authority in the location of the market and has permission to the right of the organization of the market acquired according to the procedure, established by the Government of the Russian Federation;
