1. 2. To provide to the center of provision of pensions of the Ministry of Defence of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan;

3) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1) and 2) of this Item within ten calendar days from the date of its first official publication.

3. To impose control of execution of this order on the supervising deputy defense secretary of the Republic of Kazakhstan.

4. Bring this order to officials, regarding them concerning.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. This Instruction for payment of immediate compensation in case of death (death) of the serviceman during passing of military service or the person liable for call-up called on military charges by him in case of establishment to it disability or in case of receipt of the mutilation connected with fulfillment of duties of military service by it (further - the Instruction) disaggregates implementation of payment of immediate compensation (further – compensation) in case of death (death) of the serviceman during passing of military service or the person liable for call-up called on military charges by it in case of establishment to it disability or in case of receipt of the mutilation connected with fulfillment of duties of military service by it.

2. Work on payment of compensation includes:

1) document creation in case of death (death) of the serviceman or the person liable for call-up;

2) document creation in case of establishment to the serviceman or the person liable for call-up of disability;

4. MOVA or military units (organizations) within 10 (ten) working days completes the documents necessary for payment of compensation and send them to the Center of provision of pensions of the Ministry of Defence of the Republic of Kazakhstan (further – TsPO).

5. Compensation payment to the serviceman, person liable for call-up or person having the right to its obtaining is performed by the Center of financial provision of the Ministry of Defence of the Republic of Kazakhstan (further – the CFD) based on the documents submitted by TsPO.

Chapter 2. Document creation in case of death (death) of the serviceman or the person liable for call-up

In case of death (death) of the serviceman or the person liable for call-up during passing of military service (military charges) or after dismissal from service (military charges) owing to mutilation (wound, injury, contusion), the diseases got during passing of military service to heirs compensation is paid.

7. For the purpose of determination of cause of death (death) of the serviceman or the person liable for call-up by military unit (organization) in which it passed military service (military charges) office investigation according to requirements of the subitem 10) of Item 30 of the Charter of internal service of Armed Forces, other troops and military forming of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of July 5, 2007 No. 364 "About approval of all-army regulations of Armed Forces, other troops and military forming of the Republic of Kazakhstan" is made (further – the Charter).

8. After conducting office investigation by military unit (organization) the following documents are processed:

1) materials of office investigation of death (death) of the serviceman or person liable for call-up;

2) the certificate of the size of monetary pay of the died (dead) at the time of the event in form according to appendix 2 to Rules of payment of immediate compensation in case of death (death) of the serviceman during passing of military service or the person liable for call-up called on military charges by it in case of establishment to it disability or in case of receipt of the mutilation connected with the fulfillment of duties of military service approved by the order of the Government of the Republic of Kazakhstan of August 27, 2013 No. 868 by it (further – Rules);

3) the statement from the order of the commander of military unit (the head of organization) on exception of the serviceman or the person liable for call-up from lists of military unit (organization).

After document creation military units (organizations) within three working days sends them to MOVU at the place of residence of heirs.
