About the status of the science city of the Russian Federation

Article 1. Basic concepts

For the purposes of this Federal Law the following basic concepts are used:

the science city of the Russian Federation (further - the science city) - the municipality with the status of the city district having high scientific and technical potential with city-forming scientific-industrial complex;

scientific-industrial complex of the science city - set of the organizations performing scientific, scientific and technical, innovative activities, experimental developments, testing, training according to the state priority directions of development of science, technologies and the equipment of the Russian Federation;

science city infrastructure - set of the organizations which are providing activity of the population of the science city and functioning of its scientific-industrial complex, but not entering this complex.

Article 2. Legal regulation of the status of the science city

Legal regulation of the status of the science city is performed according to the Constitution of the Russian Federation, the Federal Laws on the general principles of the organization of local self-government, on science and the state scientific and technical policy, other Federal Laws, this Federal Law, constitutions, charters and the laws of subjects of the Russian Federation.

Article 2.1. Criteria of assignment to the municipality of the status of the science city and preserving such status

1. The municipality applying for assignment of the status of the science city or preserving such status shall have the scientific-industrial complex located in the territory of this municipality.

2. As the municipality applying for assignment of the status of the science city or preserving such status are developed and affirm the strategy of social and economic development of the municipality which is subject to coordination with the federal executive body performing functions on development and realization of state policy and normative legal regulation in the sphere of scientific, scientific and technical and innovative activities and the actions plan on strategy implementation of social and economic development of the municipality.

3. The strategy of social and economic development of the municipality applying for assignment of the status of the science city or preserving such status shall include the Section which contains, in particular:

1) the characteristic of scientific, scientific and technical, innovative capacities of the organizations entering into scientific-industrial complex of the science city;

2) methods and development mechanisms of scientific, scientific and technical potentials and use of scientific-industrial complex of the science city for goal achievement and the solution of tasks of social and economic development of the municipality.

4. The actions plan on strategy implementation of social and economic development of the municipality applying for assignment of the status of the science city or preserving such status includes the actions promoting:

1) to development of scientific-industrial complex of the science city, including small and medium scale enterprises;

2) implementation of the innovative projects directed to creation and development of production of high-technology industrial output and (or) innovative goods and services according to the priority directions of development of science, technologies and the equipment of the Russian Federation;

3) to preserving and development of infrastructure of the science city.

5. The scientific-industrial complex of the science city shall include the organizations registered in the procedure established by the legislation of the Russian Federation in the territory of this municipality and which are:

1) the scientific organizations performing scientific, scientific and technical, innovative activities according to the priority directions of development of science, technologies and the equipment of the Russian Federation, the educational organizations of the higher education;

2) the organizations irrespective of their forms of business and patterns of ownership performing production of goods, performance of works, rendering services (including according to the priority directions of development of science, technologies and the equipment of the Russian Federation) provided that the share made by the organization within calendar year of high-technology industrial output and (or) innovative goods (the performed innovative works, the rendered innovative services) in value term constitutes at least than 50 percent of total amount made during the specified period of goods (the performed works, the rendered services);

3) the organizations irrespective of their forms of business and patterns of ownership which performed fully or partially preparations (including design and exploration work, new construction, modernization, upgrade of fixed assets, reconstruction of buildings, acquisition of machines, the equipment), necessary for production of high-technology industrial output and (or) innovative goods (accomplishment of innovative works, rendering innovative services) according to the priority directions of development of science, technologies and the equipment of the Russian Federation;

4) economic societies and economic partnership which are created in the procedure established by the Federal Laws by the scientific organizations and the educational organizations of the higher education specified in the subitem of 1 this Item and which activities consist in practical application (implementation) of results of intellectual activities on which exclusive rights belong to the specified organizations (including together with other persons).

6. The scientific-industrial complex of the science city along with the organizations specified in Item 5 of this Article shall include the separate divisions of the organizations registered in the procedure established by the legislation of the Russian Federation in the territories of other municipalities which are in the territory of this municipality provided that such separate divisions conform to requirements, stipulated in Item the 5th this Article (further - separate divisions).

7. Compliance of the organizations, separate divisions to requirements, stipulated in Item to the 5th this Article, is confirmed by the data obtained as a result of federal statistical observation or if federal statistical observation on the corresponding indicators was not performed, data of the organizations and (or) separate divisions of scientific-industrial complex of the science city, constituent documents of these organizations.

8.
