About approval of the requirements concerning the admission and sale of seeds of local grades / the primitive types and agricultural grades adapted for local conditions and grades of vegetable cultures to which the genetic erosion threatens

Based on article 2 of the Law No. 94/2015 on accession of the Republic of Moldova to the International treaty on vegetable genetic resources for production of food and farming (The official monitor of the Republic of Moldova, 2015, Art. No. 150-159, 311) DECIDES: the Government

1. Approve:

1) Requirements for establishment of certain exceptions for the admission of the local grades and agricultural types which are naturally adapted for local and regional conditions and to which the genetic erosion, and for trade in seeds and sowing tubers of these local grades and types, according to appendix No. 1 threatens;

2) Requirements for establishment of certain exceptions for the admission of local grades / primitive types and grades of the vegetables which are traditionally grown up in special areas and regions to which the genetic erosion, and the grades of the vegetables which do not have intrinsic value for production of commodity vegetables, but created for cultivation in special conditions and also for trade in seeds of these local grades / primitive types and grades, according to appendix No. 2 threatens.

2. This resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.

Requirements for establishment of certain exceptions for the admission of the local grades and agricultural types which are naturally adapted for local and regional conditions and to which the genetic erosion, and for trade in seeds and sowing tubers of these local grades and types threatens

These Requirements shift the Directive of the Commission 2008/62/EU of June 20, 2008, establishing certain exceptions for the admission of the local grades and agricultural types which are naturally adapted for local and regional conditions and to which the genetic erosion, and also for trade in seeds and sowing tubers of these local grades and types (the text urgent for the EEA) threatens, (it is published in the Official magazine of the European Union by L 162 of June 21, 2008, p. 13), with the correction published in the Official magazine of the European Union L 111, of May 5, 2009, p. 51 (08/62).

I. Scope

1. In view of the Order of the Government No. 1211/2008 about approval of the Requirement "Seed grain of corn and sorghum", the Order of the Government No. 836/2011 about approval of Quality requirements and trade in seeds of fodder plants, the Order of the Government No. 915/2011 about approval of Quality requirements and to placement in the market of seeds of oil-bearing and spinning crops, the Order of the Government No. 713/2013 about approval of Requirements to production and realization of seeds, seedling and material for landing of vegetable cultures, the Order of the Government No. 189/2010 about approval of the Minimum requirements on realization of seed potato, the Order of the Government No. 600/2014 about approval of Quality requirements and trade in seeds of grain grains of cultures, Requirements for establishment of certain exceptions for the admission of local grades and agricultural types, naturally adapted for local and regional conditions and to which the genetic erosion threatens and for trade in seeds and sowing tubers of these local grades and types (further - Requirements) the certain exceptions connected with preserving in situ and steady use of genetic resources of plants by means of their cultivation and sale on purpose establish:

1) the admission to registration in the Catalogue of plant varieties according to the Order of the Government No. 43/2013 about approval of Regulations about testing and entering of grades into the Catalogue of the plant varieties, local grades and agricultural types which are naturally adapted for local and regional conditions and to which the genetic erosion threatens;

2) realization of seeds and seed potato of these types and grades.

2. For the purposes of these Requirements the following concepts are applied:

preserving in situ - preserving genetic material in its natural environment, and in case of the local cultivated types of plants - in the agricultural circle in which they developed the distinctive properties;

genetic erosion - loss eventually inside - and interpopulation genetic variety or reducing genetic base of type because of intervention of the person or climate change;

local grade - set of populations or clones of type of the plants which naturally adapted to ecological conditions of the region;

seeds - seeds and seed potato, except as specified, when the seed potato is directly excluded.

II. Acceptance of conservation grades

3. State commission on testing of plant varieties (further - GKISR) allows the local grades and types specified in the subitem 1) of Item 1, which the requirements established in Items 4, 5 and 6 extend. Such local grades or types are mentioned in the Catalogue of plant varieties as conservation grades.

4. To be accepted as conservation grade, the local grade or type specified in the subitem 1) of Item 1, shall be of interest to preserving genetic resources of plants, and expenses on testing, registration and the subsequent maintenance of the grades which are under the threat of genetic erosion are born by the state.

5. As for distinguishing features, uniformity and stability, shall be applied, at least, the characteristics specified in technical descriptions, according to test reports of Service of Community of plant varieties, mentioned in the Order of the Government No. 43/2013 approval of Regulations testing and entering of grades into the Catalogue of plant varieties which are applied to the corresponding types, or the technical descriptions attached to managements of International union on protection of new plant varieties which are applied to the corresponding types.

However if the level of uniformity is established on the basis of atypical grades, standard population of 10% and probability of the acceptability at least 90% shall be applied.
