According to subitem 4-5) of part one of article 27 of the Law of the Republic of Kazakhstan "About microfinancial activities" Board of the Agency of the Republic of Kazakhstan on regulation and development of the DECIDES: financial market

1. Approve:

1) Rules of issue of permission to voluntary reorganization of the microfinancial organization in the form of converting in bank according to appendix 1 to this resolution;

2) the List of the documents necessary for issue of permission of authorized body to voluntary reorganization of the microfinancial organization in the form of converting in bank according to appendix 2 to this resolution;

3) the Application form for receipt of permission to voluntary reorganization of the microfinancial organization in the form of converting in bank according to appendix 3 to this resolution;

4) the Form of permission to voluntary reorganization of the microfinancial organization in the form of converting in bank according to appendix 4 to this resolution;

5) the Form of information about the shareholder – the physical person holding shares of the microfinancial organization in the amount of less than 10 (ten) percent in form according to appendix 5 to this resolution;

6) the Form of information about the shareholder – the legal entity holding shares of the microfinancial organization in the amount of less than 10 (ten) percent in form according to appendix 6 to this resolution.

2. To provide to department of methodology and prudential regulation of the financial organizations in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.

3. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.

4. This resolution becomes effective after sixty calendar days after day of its first official publication.

Rules of issue of permission to voluntary reorganization of the microfinancial organization in the form of converting in bank

Chapter 1. General provisions

1. These rules of issue of permission to voluntary reorganization of the microfinancial organization in the form of converting in bank (further – Rules) are developed according to the Administrative procedural Procedure Code of the Republic of Kazakhstan (further – APPK), subitem 4-5) of part one of article 27 of the Law of the Republic of Kazakhstan "About microfinancial activities" (further – the Law on microfinancial activities) and determine approval procedure of the microfinancial organization on voluntary reorganization in the form of converting in bank.

2. The concepts used in Rules are applied in the values specified in the Law on microfinancial activities, the Law of the Republic of Kazakhstan "About banks and banking activity in the Republic of Kazakhstan" (further – the Law on banks), the Law of the Republic of Kazakhstan "About permissions and notifications".
