Article 1. Registration bases at the place of residence and the place of stay

Citizens of the Azerbaijan Republic, foreigners and stateless persons (further - persons) shall be registered at the place of residence and the place of stay. The registration purpose at the place of residence and the place of stay is creation of necessary conditions for registration of persons living in the Azerbaijan Republic, execution of obligations by them before other persons, the state and society, implementation of rights and freedoms of man and citizen (social protection, provision of pensions, appeal on military service, execution of judgments, etc.).

Registration at the place of residence and the place of stay has no allowing character and only in the cases established by the legislation of the Azerbaijan Republic can entail consequence in law.

For registration at the place of residence and the place of stay other documents, except specified in this Law cannot be requested.

Article 2. Concepts of the residence and place of stay

The residence is the place where sui juris person permanently or mainly lives in quality of the owner, according to the employment contract, the lease agreement or on other bases, stipulated by the legislation the Azerbaijan Republic, - the apartment house, the apartment, office premises, the hostel, the companies of social servicing for aged and persons with disability, including children up to 18 years with limited opportunities of health, special educational institutions, other similar premises.

The place of stay is the place where person temporarily lives, hotel, sanatorium, rest house, boarding house, camping, tourist center, hospital, other similar organization, and also premises (the, the relative, the acquaintance and so forth), not being place of his residence.

The residence of minors aged up to 14 years or persons which are under guardianship the residence of their legal representatives - according to parents, adoptive parents or guardians is considered.

Registration of the lost parents and children deprived of parent guardianship established by the Law of the Azerbaijan Republic "About social protection of the children who lost parents and deprived of parent guardianship" is conducted both at the place of residence, and in the place of temporary stay (organization for the children who lost parents and deprived of parent guardianship, the hostel the residence of the guardian (custodian), adoptive parent (foster home), the adopted person).

Article 3. Documents on establishment of the residence

The residence is established by the following documents:

1) concerning the citizen of the Azerbaijan Republic - the identity certificate or the personal ID card of the citizen of the Azerbaijan Republic;

2) No. 582-IVQD is excluded according to the Law ARE of 05.03.2013

3) in the relation constantly or the foreigner who is temporarily living in the Azerbaijan Republic or person without grazhdanstvo the certificate of special sample;

Article 4. Bases for registration restriction

Registration at the place of residence and the place of stay in border area, in the closed military camps, the closed territories, zones of ecological catastrophe, in the territories where in connection with danger of spread of infectious diseases and poisonings special conditions and the modes are entered, in the territories where the emergency or warlike situation is entered, in case of declaration of war or mobilization can be limited.

Article 5. Registration of the citizen at the place of residence

Registration at the place of residence of the citizen who is not registered at the place of residence is performed in case of the first delivery to it identity certificates of the citizen of the Azerbaijan Republic. In this case the citizen only shall fill in the statement questionnaire for certification of the personality provided by "Regulations on application of the Law of the Azerbaijan Republic "On registration at the place of residence and the place of stay" and, in addition to the documents which are required for certification to submit the document specified in Item 2 of the second part of article 5 of this Law and which is the basis for installation in living space.

The citizen who replaced the residence no later than 10 days after arrival on the new residence, having addressed for registration to relevant organ of the executive authority, shall submit the following documents together with the statement questionnaire for registration at the place of residence in the form established by relevant organ of the executive authority:

1) identity certificate;

2) the document which is the basis for settling to premises (the statement from the state real estate register about state registration of the property right, the order, the lease agreement or hiring or other document, stipulated by the legislation the Azerbaijan Republic), or the statement of person which provided to the citizen premises.

The relevant organ of the executive authority shall register instantly at the place of residence of the citizen who submitted the relevant documents in connection with change of the residence and to enter information on the residence in the electronic medium of its identity certificate.

Registration of the citizen who did not reach 15-year age is performed in the presence of the address of his legal representative. In this case the legal representative of the citizen submits the following documents:

1) the statement questionnaire for registration of the citizen who did not reach 15-year age at the place of residence (the form affirms relevant organ of the executive authority);

2) certificate of birth;

3) the document specified in Item 2 of the second part of article 5 of this Law which is the basis for installation in living space.

If receipt of the documents provided by this Article from the relevant state body (structure) by means of the Information system "Electronic Government" perhaps, then the specified documents are not subject to reclamation at the applicant. If receipt of such documents by means of the Information system "Electronic Government" is impossible, then they, with the consent of the applicant, are subject to reclamation at the relevant state body (structure) based on request or to providing with the applicant.
