About approval of the National program for consolidation and implementation of measures of anti-terrorist protection of objects of critical infrastructure for 2022-2026 and the Action plan on its implementation

Based on part (1) article 19 of the Law No. 120/2017 on the prevention and fight against terrorism (The official monitor of the Republic of Moldova, 2017, Art. No. 364-370, 614), with subsequent changes, DECIDES: the Government

1. Approve:

1) the National program for consolidation and implementation of measures of anti-terrorist protection of objects of critical infrastructure for 2022-2026, according to appendix No. 1;

2) the Action plan on implementation of the National program for consolidation and implementation of measures of anti-terrorist protection of objects of critical infrastructure for 2022-2026, according to appendix No. 2.

2. To competent authorities in the field of the prevention of terrorism and fight against it:

1) to undertake the measures necessary for realization of provisions of the National program for consolidation and implementation of measures of anti-terrorist protection of objects of critical infrastructure for 2022-2026;

2) to provide to Service information and safety of the Republic of Moldova till January 15 annual statements about the measures taken for accomplishment of provisions of the specified Program for previous year.

3. To service of information and safety of the Republic of Moldova to perform monitoring of implementation of the National program for consolidation and implementation of measures of anti-terrorist protection of objects of critical infrastructure for 2022-2026 and to annually represent to Parliament along with the annual statement about activities information on accomplishment of the specified Program.

I. Introduction

1. Taking into consideration the situation in the field of safety at the regional and international levels which is characterized by asymmetric threats, the accelerated terrorism growth which is expressed in making of resonant shares, activation of actions for recruitment of new members and promotion of radical ideology, threats of new large-scale acts in the territory of the European Union, increase in migration flows from zones of the conflicts, testimonial of alarming tendencies of this phenomenon on the European space that, in turn, represents serious challenge for regional and national stability and safety, and also taking into consideration unsafe situation in the Republic of Moldova in view of transit through the country of the elements concerning the international terrorist organizations, shortcomings and vulnerabilities in the organization of systems of anti-terrorist protection on objects of critical infrastructure

realizing that removal from system or destruction of objects of critical infrastructure can lead to negative effects for security, safety, social and economic welfare of the state, to entail loss of significant services, danger to life, human health and negative impact on the environment, it is necessary to develop and perform at the national level complex of the continuous legal, organizational, financial and economic, technical, regime, operational, prospecting, counterprospecting and other measures taken by bodies of the central and local public authority, operators of objects of critical infrastructure (further - operators), and also specially authorized persons which purpose is ensuring functionality, continuity of functioning and integrity of critical infrastructure, for control, minimization and elimination of threats and risks or weak spots,

proceeding from belief that ensuring functionality and safety of critical infrastructure shall hold specific place in the security policy of the state which is expressed in consolidation of common efforts of bodies, competent in the field

intending to increase efficiency and to systematize actions of operators for the purpose of ensuring functionality, continuity of functioning and integrity of critical infrastructure,

being guided by requirements of the Resolution No. 2341 (2017) the Security Council of the United Nations of February 13, 2017, the Directive of the Council of the European Union No. 2008/114/EU on identification and designation of the European crucial infrastructures and assessment of need of improvement of their protection, the Law No. 120/2017 on the prevention and fight against terrorism, National strategy of defense and the Action plan on implementation of National strategy of defense for 2018-2022 approved by the Resolution of Parliament No. 134/2018, of the Regulations on anti-terrorist protection of critical infrastructure approved by the Order of the Government No. 701/2018, of the Regulations on the organization and conducting anti-terrorist testings approved by the Order of the Government No. 996/2018, of the Order of the Government No. 995/2018 about approval of the National warning system in case of terrorist threat
