About approval of the Regulations on procedure for appointment and allowance payment on burial

In pursuance of provisions of the Law on benefits of social insurance on temporary disability and other benefits of social insurance of N289-XV of July 22, 2004. The government DECIDES:

1. Approve Regulations on procedure for appointment and allowance payment to burial according to appendix No. 1.

2. Recognize invalid some orders of the Government according to the appendix N2.

Regulations on procedure for appointment and allowance payment to burial

I. General provisions

1. This provision determines procedure for the provision and allowance payment on burial established by territorial authorities of National cash desk of social insurance (in dalneyshemnatsionalny cash desk).

2. The benefit for burial is lump-sum benefit which is provided for the purpose of material support of family of the dead or person who incurred expenses on his burial.

3. The benefit for burial is not provided if face is announced by the died decision of degree of jurisdiction.

4. According to this provision family members are:

a) spouse (spouse);

b) parents;

c) the children who did not reach age of 18 years (including deadborn), or if they studied at full-time department in educational institution, - before the end of study, but no later than achievement of 23-year age by them, and also children with restrictions of opportunities irrespective of age if restriction of opportunities was set before achievement of the above-stated age.

5. In case of the death of insured person one person who showed the registration certificate of death granted by competent authority of the Republic of Moldova has the right to benefit for burial.

In case of the death of uninsured person one of members of the family of the dead, the guardian or the custodian of the dead or, in their absence, person who proves that it incurred expenses on his burial has the right to benefit for burial.

Specified persons have the right to benefit for burial irrespective of, are or are not citizens of the Republic of Moldova, and also from that, have or have no permanent residence in the Republic of Moldova.

6. If the international agreement (convention) which party the Republic of Moldova is establishes other rules, than provided by this provision rules of the international agreement (convention) are applied.

II. Conditions for purpose of benefit for burial of persons insured in system of the national social insurance

7. Have the right to benefit for burial in case of the death of persons having the permanent residence or the place of residence in the Republic of Moldova:

a) insured in the state system of social insurance, irrespective of duration of insurance years of service, and also the unemployed having entitlement to benefit on unemployment;

b) the pensioners receiving pension of the national social insurance;

c) the persons which are not insured persons, but having general insurance years of service at least 3 years;

d) ceased to be valid.

III. Conditions of purpose of benefit for burial of persons who are not insured in system of the national social insurance

8. The right to Benefit for burial, in case of the death of uninsured person, is provided to persons specified in the paragraph the second Item 5, having the permanent residence or the place of residence in the Republic of Moldova.

8-1. As uninsured persons, according to the this provision conditions, are considered:

a) persons who are not confirming insurance years of service in the state system of social insurance;

b) persons specified in the subitem c) item 4.

IV. Procedure for purpose of benefit for burial

9. In case of the death of two or more persons specified in Items 7 and 8 of this provision, the benefit is provided on burial of each of them.

10. The right to benefit for burial is established by territorial cash desk of social insurance (further territorial cash desk) at the place of residence or the place of residence of the dead according to the decision on purpose of benefit for burial issued by territorial cash desk.

11. The benefit for burial is established based on the application submitted by person specified in Item 5 of this provision. The following documents are enclosed to the application:

a) the identity certificate of the applicant (in the original and its copy). In the absence of the specified document the identity of the receiver can be supported by other documents, including the documents of temporary use issued by competent authorities;

b) the certificate of death issued by department of civil status (in the original of f-25);

c) the act of registration of death in the original and its copy;

d) as necessary, the acts confirming relationship in the original and the copy.

Persons specified in the paragraph the second Item 5 of this provision shall provide in addition to the documents specified in paragraph one of this Item, the documents confirming expenses on burial.

In case of the birth of the dead child the benefit for burial is provided based on the application submitted by person specified in part two of Item 5 of this provision. The following documents are enclosed to the application:

a) the identity certificate of the applicant (in the original and its copy). In the absence of the specified document the identity of the receiver can be supported by other documents, including the documents of temporary use issued by competent authorities;

b) No. 290 is excluded according to the Order of the Government of the Republic of Moldova of 07.05.2013

c) the documents confirming expenses on burial.

12. The statement for provision of benefit for burial is registered territorial cash desk on the permanent residence or in the place of residence of the dead for date of presentation of all documents provided in Item 11 of this provision.

13. The statement for provision of benefit for burial, the decision on purpose of benefit for burial and necessary documents are stored in personal/pension record.

14. The benefit for burial is paid in fixed amount.
