Regulations on procedure for provision and payment of additional vacation to some categories of persons

I. General provisions

1. This provision establishes procedure for provision and payment of additional vacation lasting 14 calendar days (further – additional vacation) with preserving the salary to the persons who got sick and had the radiation sickness caused by consequences of the Chernobyl accident and also to persons with limited opportunities concerning which the causal relationship of the come restriction of opportunities is established with the Chernobyl catastrophic crash according to the Law No. 909-XII of January 30, 1992. "About social protection of the citizens who were injured owing to the Chernobyl catastrophic crash", and also to the staff of divisions of extra risk, the patients with radiation sickness or received extent of restriction of opportunities, according to the Order of the Government No. 575 of September 2, 1992. II. Categories of persons having the right to additional paid leave

2. The additional paid leave is granted to persons specified in article 6 of the Law N909-XII of January 30, 1992 and also persons specified in Item 1 of the Order of the Government N575 of September 2, 1992 namely:

a) to the persons who got sick and had the radiation sickness caused by consequences of the Chernobyl accident and also to disabled people, persons with limited opportunities concerning which the causal relationship of the come restriction of opportunities is established with the Chernobyl catastrophic crash, from number:

persons (temporarily directed or sent) who were taking part in recovery from the accident in exclusion zone or other works on the Chernobyl NPP;

the military personnel, employees of the law-enforcement bodies, persons liable for call-up called on special charges, serving in this the period in Armed forces, troops and bodies of Committee for State Security, internal and railway troops, other military forming and involved to performance of works on recovery from the accident in exclusion zone or other works on the Chernobyl NPP;

the persons which arrived in 1986 from exclusion zone and who obtained citizenship of the Republic of Moldova;

a 1) to persons (temporarily directed or sent) taking in 1986-1987 part in works on recovery from the accident on the Chernobyl NPP in exclusion zone and also the military personnel, employees of law-enforcement bodies and persons liable for call-up called on special charges, serving in this the period in Armed forces, troops and bodies of KGB, internal and railway troops, other military forming and performing works in exclusion zone on mitigation of consequences of the specified accident;

a 2) of person (temporarily directed or sent) taking in 1988-1990 part in works on recovery from the accident on the Chernobyl NPP in exclusion zone and also the military personnel called on the special charges serving in this the period in Armed forces, troops and bodies of KGB, internal and railway troops, other military forming and performing works in exclusion zone on mitigation of consequences of the specified accident.

b) to the staff of divisions of extra risk (to the military personnel and the civilian as a part of Armed Forces of the former USSR, troops and bodies of the Ministry of homeland security, internal troops, railway troops and other military forming, to faces of the commanding and ordinary structure of law-enforcement bodies), the patient with radiation sickness or received extent of restriction of opportunities which were directly involved in:

testing of nuclear weapon in the atmosphere and fighting radioactive materials, doctrines using such weapon before date of the actual termination of similar testing and doctrines;

underground testing of nuclear weapon in the conditions of emergency radiation situations and other striking factors of nuclear weapon;

to assembly of nuclear weapon (staff of separate divisions);

liquidations of radiation accidents on nuclear installations of the surface and underwater ships and other military facilities;

underground testing of nuclear weapon, carrying out and ensuring works on collection and burial of radioactive materials.

III. Conditions of provision and procedure of payments of payment of additional vacation

3. The amount of payment of additional vacation is calculated the employer based on the application submitted by the applicant on condition of provision of copies of the documents specified in item 4. If person works in several organizations, the amount of payment of additional vacation is calculated each employer for the same period of additional vacation.

4. Copies of the following documents are without fail enclosed to the application:

the identity certificate confirming nationality of the Republic of Moldova;

certificate of the participant of mitigation of consequences of the Chernobyl catastrophic crash;

the certificate on restriction of opportunities and working capacity issued by the National consultation of establishment of the restriction of opportunities and working capacity or its structures confirming receipt of the extent of restriction of opportunities which came in connection with consequences of the Chernobyl catastrophic crash;

certificates of the employee of divisions of extra risk.
