1. Approve Methodology of processing of the customs declaration by information method according to appendix.

2. This methodology becomes effective since January 1, 2007.

3. To chiefs of customs to bring contents of this order to the attention of customs brokers and customs applicants.

Methodology of processing of the customs declaration by information method

Section I. Determinations

1. In case of application of these rules it is necessary to understand:

a) information method of declaration of goods - set of the instructions and actions allowing to declare goods by means of customs information system;

b) the user of information system - the legal entity using information method of declaration of goods and which can be the customs applicant or the customs broker user of information system according to provisions of this Section;

c) the customs applicant user of information system - the person meant in Art. 1 of item 13 of the Customs code of the Republic of Moldova, declaring goods without resorting to services of the customs broker, and having right to use of customs information system for declaration of goods on the basis of permission of access to the information module for processing of the customs declaration in information system;

d) the customs broker user of information system - the person meant in Art. 162 of the Customs code of the Republic of Moldova, connected to customs information system on the basis of the corresponding permission of access to the information module for processing of the customs declaration in information system;

e) the information module - component of software of customs information system for creation of the customs declaration and receipt of the right of release of goods;

f) permission code - the code assigned in information system for the customs applicant or the customs broker - to users of information system;

g) corridor of customs control - the group on the basis of the predetermined selective criteria causing application of different types of customs control in the course of customs clearance of goods;

h) the green channel of customs control - the corridor of customs control providing release of goods without implementation of documentary control and physical examination;

i) yellow corridor of customs control - the corridor of customs control providing release of goods after mandatory documentary control;

j) the red channel of customs control - the corridor of customs control providing release of goods after mandatory documentary control and physical examination;

j-1) blue corridor for customs clearance – the corridor assuming passing of customs control without verification of documents and personal inspection, but allowing further selective customs control by reverification of the data specified in the customs declaration;

j) acceptance sorting Item - the workplace determined by customs authority where the customs applicant or his representative submits the customs declaration printed according to the chosen customs regime, fastened with the sign and seal together with the documents attached to it, documents on payment or on guarantee of customs obligations, and also the list of documents in which they are reflected;

l) Item of financial control - the workplace determined by customs authority where are checked payment procedure or guaranteeing customs obligations, and also compliance of the guarantees specified in the customs declaration with effected payment or with guarantees of customs obligations;

m) Item of documentary control - the workplace determined by customs authority where documentary control as the customs declarations selected along the red channel and the declarations selected along yellow corridor of customs control is exercised;

n) Item of physical examination - the workplace determined by customs authority where physical goods inspection, the customs declarations constituting subject selected along the red channel is performed;

o) legality giving Item - the workplace determined by customs authority where stages of passing of the customs declaration are checked. In this Item of the customs declaration legality by means of information system then the goods are issued is given;

p) the sheet about payment - the electronic document ASYCUDA World reflecting the used payment methods of customs obligations;

q) sequence number - the number which is written down manually by the user which allows to identify the kept customs declaration on the server. The sequence number registers in the 7th column of the customs declaration;

r) registration number - the single number and date in the Ixxxxxxxx-ZZ/II/aaaa form appropriated to the customs declaration by information system; number of registration is equivalent to adoption of the customs declaration, and registration date means the moment from which there are rights and the obligations inherent in the chosen customs regime. Registration number is put down in the Section A of the customs declaration;

s) number of giving of legality - the single number and date of the Vxxxxxxxx-ZZ/II/aaaa form appropriated to the customs declaration by information system equivalent to giving of legality of the customs declaration by means of information system. Number of giving of legality is entered in the Section In the customs declaration;

t) number of the sheet about payment - the single number and date in the Rxxxxxxxx-ZZ/II/aaaa form appropriated to the customs declaration by information system testimonial of payment or accomplishment of guarantees according to customs obligations concerning the goods constituting subject of the customs declaration. u) the list of the enclosed documents - the electronic document ASYCUDA World containing the exhaustive list of all documents attached to the customs declaration (invoices, certificates of origin, technical prospectuses, legal acts, etc.), and also their data (series, number, calendar numbers);
