About holding checking actions in connection with provision of the admission to the state secrets

Based on subitem 10.4 of Item 10 of the Regulations on Committee for State Security of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of July 23, 2013 No. 325, of part two of Item 8 of the Regulations on the admission to the state secrets of foreign citizens, stateless persons, and also the citizens of the Republic of Belarus who are constantly living beyond its limits, No. 486 approved by the Presidential decree of the Republic of Belarus of December 20, 2018 (further - Regulations on the admission to the state secrets of foreign citizens), parts two of Item 7 of the Regulations on procedure for provision to citizens of the Republic of Belarus of the admission to the state secrets approved by the resolution of Council of Ministers of the Republic of Belarus of January 25, 2019 No. 53, Committee for State Security of the Republic of Belarus DECIDES:

1. Determine that:

1.1. checking actions is the complex of the operational search and other events held by the state security agencies concerning the citizens of the Republic of Belarus who are constantly living in the Republic of Belarus (further - citizens), the citizens of the Republic of Belarus who are constantly living outside the Republic of Belarus, foreign citizens, stateless persons (further - foreign citizens) in connection with provision of the admission by it to the state secrets (further - the admission), implementation of activities by them in the field of the state secrets;

1.2. during implementation of checking actions the staff of the state security agencies can conduct operational survey, targeting of references, collection is model, research of objects and documents, computer information, operational identification, observation and other actions according to the procedure, stipulated by the legislation, local legal acts of Committee for State Security and also to receive data from bases and databanks (accounting), information systems by remote access and (or) on material data carriers;

1.3. holding checking actions is performed in terms, stipulated in Item 6 Regulations on procedure for provision to citizens of the Republic of Belarus of the admission to the state secrets, Item 7 of the Regulations on the admission to the state secrets of foreign citizens;

1.4. taking into account results of holding checking actions by the state security agency provision approval to the citizen of the admission (pronouncement of the conclusion about provision to the foreign citizen of the admission) or refusal in provision approval to the citizen of the admission (pronouncement of the conclusion about impossibility of provision to the foreign citizen of the admission) is performed or the instruction can be introduced in the state body and other organization performing activities with use of the state secrets (further - the organization), about the termination of the admission to the citizen, the foreign citizen;

1.5. taking into account results of holding checking actions by the state security agency the refusal in provision approval to the citizen of the admission (pronouncement of the conclusion about impossibility of provision to the foreign citizen of the admission) is performed, the instruction is introduced in the organization about the termination of the admission to the citizen, the foreign citizen in case:

identifications of the bases provided by part one of article 37 of the Law of the Republic of Belarus of July 19, 2010 No. 170-Z "About the state secrets";

receipts of data on the actions of the citizen, the foreign citizen creating threat of homeland security of the Republic of Belarus.

Taking into account results of holding checking actions by the state security agency the refusal in provision approval to the citizen of the admission (the conclusion about impossibility of provision to the foreign citizen of the admission is taken out) can be performed, the instruction is introduced in the organization about the termination of the admission to the citizen, the foreign citizen in case of identification by the state security agency of the bases provided by part two of article 37 of the Law of the Republic of Belarus "About the state secrets".
