About local self-government

(as amended of the Law of Turkmenistan of 16.03.2023)

This Law establishes the legal basis of implementation of local self-government, procedure for education and activities, power of local government bodies, their officials, members and regulates relations with public authorities.

Chapter I. General provisions

Article 1. Local self-government

1. Local self-government is direct or through representative bodies the organization of activities of citizens on the basis of the Constitution and the laws of Turkmenistan proceeding from interests of all population in the corresponding territory for the independent solution of questions of local value and requirements satisfaction of the population.

2. Public authorities create legal, organizational, material and financial and other conditions for formation of local government bodies and enhancement of their activities.

Article 2. System of local self-government

1. The system of local self-government is formed Gengesha and by bodies of territorial public self-government.

2. Gengesha are representative bodies which members are elected the citizens of Turkmenistan living in the corresponding administrative and territorial units on the basis of general, equal and direct suffrage secret vote for a period of five years. The procedure for elections of members of Gengesh is determined by the Constitution of Turkmenistan and the Electoral code of Turkmenistan.

3. Bodies of territorial public self-government are the community of capable physical persons which does not have membership (further - physical persons) on voluntary basis, without formation of legal entity which purpose is the joint solution of various social problems directed to population requirements satisfaction in the corresponding territory.

4. Local government bodies are not a part of the system of public authorities.

Article 3. Legislation of Turkmenistan on local self-government

The legislation of Turkmenistan on local self-government is based on the Constitution of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan.

Article 4. Right of citizens to implementation of local self-government

1. The citizens of Turkmenistan living in the corresponding administrative and territorial units perform local self-government by participation in local referenda, elections, meetings, and also through elected bodies or meetings of local self-government.

2. Citizens irrespective of nationality, skin color, floor, origin, property and official capacity, the residence, language, the relation to religion, political convictions or other circumstances have the equal rights to implementation of local self-government directly or through the elective representatives.

Foreign citizens, stateless persons, constantly or mainly living in the corresponding territory, can participate in local self-government according to the legislation of Turkmenistan.

3. Restriction of the rights of citizens for implementation of local self-government is forbidden.

4. Public authorities provide the state guarantees of the rights of citizens for implementation of local self-government.

Article 5. Basic principles of activities of local government bodies

The basic principles of activities of local government bodies are legality, priority of the rights, freedoms and legitimate interests of the person, publicity, independence in the solution of questions of local value, mutual assistance, respect for national traditions.

Article 6. Legal guarantees of local government bodies

1. Local government bodies are independent within the powers and perform in the corresponding territory of power, established by the legislation.

2. Intervention in activities of local government bodies in the questions relating to their powers is not allowed.

Article 7. State support and coordination of activities of local government bodies

Public authorities create necessary conditions for conducting independent activities of local government bodies within powers and promote citizens in implementation of the rights to local self-government.
