According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the field of provision of services of mail service is evaluated and frequency of holding planned actions of the state supervision (control) by the National commission performing state regulation in spheres of electronic communications, radio-frequency range and rendering services of mail service which are applied is determined.

2. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of February 6, 2019 "About approval of criteria by which the risk degree from implementation of economic activity in the field of telecommunications is evaluated and is determined No. 191 frequency of holding planned actions of the state supervision (control) by the National commission performing state regulation in the field of communication and informatization" (The Official Bulletin of Ukraine, 2019 No. 23, the Art. 816);

item 4 of changes which are made to resolutions of the Cabinet of Ministers of Ukraine, approved by the resolution of the Cabinet of Ministers of Ukraine of January 15, 2020 No. 14 (The Official Bulletin of Ukraine, 2020, No. 10, the Art. 401).

Criteria by which the risk degree from implementation of economic activity in the field of provision of services of mail service is evaluated and frequency of holding planned actions of the state supervision (control) by the National commission performing state regulation in spheres of electronic communications, radio-frequency range and provision of services of mail service is determined

1. Criteria by which the risk degree from implementation of economic activity in the field of provision of services of mail service is evaluated are:

amount of types of service of mail service;

number of regions of Ukraine (territory of the Autonomous Republic of Crimea, one or several areas, mm. Kiev and Sevastopol) and/or foreign states in which the subject of managing has the right to implementation of activities in the field of provision of services of mail service;

the number of addresses (claims) of users of services of mail service which arrived to the National commission performing state regulation in spheres of electronic communications, radio-frequency range and rendering services of mail service, from January 1 to October 15 the year preceding planning period;

the number of instructions outstanding at the scheduled time about elimination of violations of requirements of the legislation on mail service in the field of provision of services of mail service for the period after the end of the last scheduled inspection till October 15 of the current year preceding planning period.

2. Risks of approach of negative effects from implementation of economic activity in the field of provision of services of mail service it is determined in appendix 1.

3. The exhaustive list of criteria by which the risk degree from implementation of economic activity in the field of provision of services of mail service is evaluated their indicators and the number of points are determined by each indicator in appendix 2.

4. Reference of the subject of managing in the field of provision of services of mail service to high, average or insignificant risk degree is performed by charge of score by the criteria specified in appendix 2, on the following scale:

from 41 to 100 points - high risk;

from 21 to 40 points - to average risk degree;

from 0 to 20 points - to insignificant risk degree.

5. Planned actions of the state supervision (control) of carrying out economic activity by the subject of managing in the field of provision of services of mail service are performed by the National commission performing state regulation in spheres of electronic communications, radio-frequency range and rendering services of mail service with such frequency:

with high risk - is not more often than once in two years;

with average risk degree - is not more often than once in three years;

with insignificant degree of risk - is not more often than once in five years.

6. In case when by results of two last scheduled and/or unscheduled inspections the facts of fundamental breach of requirements of the legislation on mail service in the field of rendering services of mail service are not elicited, the following scheduled inspection of such subject of managing is carried out not earlier than through the period of time established for the corresponding risk degree, increased in time 1,5. This provision is not applied to the subjects of managing carried to high risk.

Frequency of holding the following planned event of the state supervision (control) concerning appropriate subject of managing is determined since end date of planning period in which the action of the state supervision (control) was performed.
