About approval of the Procedure for maintaining the register of long-term obligations within public-private partnership

According to Article 23 of the Budget code of Ukraine the Cabinet of Ministers of Ukraine decides:

Approve the enclosed Procedure for maintaining the register of long-term obligations within public-private partnership.

Procedure for maintaining the register of long-term obligations within public-private partnership

1. This Procedure determines the mechanism of maintaining the Register of long-term obligations within public-private partnership, the list of the data entered in such Register, and information is posted on the official website of Ministry of Economics.

2. The terms used in this Procedure matter the following:

The register of long-term obligations within public-private partnership (further - the register) - it is information - communication system which provides accounting of long-term obligations of managers of budgetary funds which are the state partners, including concessors (further - the state partners), under the agreements signed within state - private partnership, including to concession treaties (further - long-term obligations) on current and/or future budget periods.

Other terms in this Procedure are used in the value given in the Budget code of Ukraine, the Laws of Ukraine "About public-private partnership", "About concession" and other regulatory legal acts regulating the budget relations.

3. The Ministry of Economics provides open and free information access from the Register by its placement on the official website.

4. Holder and administrator Reestra is the Ministry of Economics, enters data in Reestr, excludes data from Reestr, and also makes changes to the data containing in Reestra.

5. The register is kept in state language electronically.

6. Entering of data into the Register is performed by Ministry of Economics based on the provided managers of budgetary funds who are the state partners of information according to appendix 1 and the copy of the agreement signed within public-private partnership, including the concession treaty (further - the agreement) / copies of the supplementary agreement to such agreement.

7. For entering of data into the Register the managers of budgetary funds who are the state partners represent to Ministry of Economics in paper form or electronically through electronic office of the user and/or electronic office of the Portal of electronic services of Ministry of Economics together with the cover letter information provided in appendix Items 2-7 1, and the copy of the agreement certified by the head of the state partner (with all appendices to it) within three working days from the date of the conclusion of such agreement.

8. For updating of data in the Register the managers of budgetary funds who are the state partners represent to Ministry of Economics in paper form or electronically through electronic office of the user and/or electronic office of the Portal of electronic services of Ministry of Economics together with the cover letter information provided in appendix Items 2-8 1, annually till January 15.

9. In case of change of the provided information provided in appendix Items 2-7 1, or the termination of term of the agreement or early termination his managers of budgetary funds which are the state partners give to Ministry of Economics in paper form or electronically through electronic office of the user and/or electronic office of the Portal of electronic services of Ministry of Economics together with the cover letter up-to-date information and/or the corresponding copy of the supplementary agreement certified by the head to the agreement within five working days from the date of the conclusion of such supplementary agreement or the expiration of the agreement or early termination of such agreement.

10. Date of submission of documents registration date of the cover letter in Ministry of Economics is considered. If documents are submitted electronically to output, festive, other non-working day or to time off after the termination of the working day, the first working day following behind such day is considered day of submission of the specified documents.

11. The Ministry of Economics within ten working days from registration date of the cover letter enters data in the register according to Appendix 1 or excludes data from the register.

12. The Ministry of Economics posts on the official website information from the Register according to appendix 2:

within ten working days from registration date of the cover letter of managers of the budgetary funds which are the state partners, rather long-term obligations, data on which are entered in the register for the first time;

monthly to the 15th of the next period in which it was given by the managers of budgetary funds who are the state partners information about long-term obligations, data on which are entered in the Register, is changed.

Appendix 1

to the Procedure

The list of the data entered in the Register of long-term obligations within implementation of public-private partnership

1. Date of inclusion in the register of long-term obligations within implementation of public-private partnership.

2. Form of implementation of public-private partnership and details of the agreement signed within public-private partnership, including the concession treaty according to which long-term obligation is undertaken.

3. The name and identification code of the legal entity in the Unified state register of the companies and organizations of Ukraine the state partner, including the concessor.

4. The name and identification code of the legal entity in the Unified state register of the companies and organizations of Ukraine the private partner, including the concessionary.

5. Location of object of public-private partnership, including concession.

6. The term for which the agreement within implementation of public-private partnership, including the concession treaty is signed.

7. Amount and the period of payment of long-term obligations with breakdown by years.

8. Amount of the paid long-term obligations with breakdown by years.
