About essential terms of the contract of surrogacy

According to part two of article 53 of the Code of the Republic of Belarus about scrap and family the Council of Ministers of the Republic of Belarus DECIDES:

1. Determine that essential terms of the contract of surrogacy are:

1.1. rendering by one woman (substitute mother) to other woman (genetic mother) of service in implantation of embryo, to incubation and the birth of the child conceived from the ovum withdrawn from organism of genetic mother;

1.2. specifying of the organization (organizations) of health care in which, (which) there will be implantation of embryo of substitute mother, observation of current its pregnancy and childbirth;

1.3. obligation of substitute mother to carry out all doctor's instructions and to represent to genetic mother and her spouse information on the state of health and the state of health of the born child;

1.4. the place of residence of substitute mother during incubation of the child;

1.5. to transfer obligation of substitute mother to genetic mother of the child after its birth and the term during which the specified transfer shall be made;

1.6. to accept obligation of genetic mother from substitute mother of the child after its birth and the term during which the child shall be accepted;

1.7. the agreement price including including cost of the service rendered by substitute mother under the agreement of surrogacy (except as specified when this service is rendered gratuitously), and also expenses on medical attendance, food, accommodation of substitute mother during incubation, childbirth and during the postnatal period;

1.8. other conditions concerning which according to the statement of one of the parties the agreement is reached.

2. This resolution becomes effective in 10 days after its official publication.
