Procedure for the direction in the Eurasian economic commission of information from provisional solutions on classification of the goods accepted by customs authorities of state members of the Eurasian Economic Union

I. General provisions

1. This Procedure determines rules of the direction in the Eurasian economic commission (further - the Commission) information from the provisional solutions on classification of goods made by the customs authorities determined by the legislation of state members of the Eurasian Economic Union on customs regulation (further respectively - information, provisional solutions, state members, the Union), structure of information, terms of its direction, participants and rules of information exchange for the purpose of the publication of information on the official site of the Union (further - the official site).

Information published on the official site has reference character.

2. For the purposes of this Procedure information exchange is performed between the state bodies of state members authorized in the field of customs regulation (further - customs authorities), and the Commission.

3. When forming information the reference books and qualifiers which are part of resources of single system of normative reference information of the Union are applied.

4. Information is created by customs authorities with use of information system of the customs authorities or components of the software of integration segment of the Commission of the integrated information system (further - the integrated system) providing possibility of their use as a part of national segments of state members of the integrated system and transferred in the automatic mode in the Commission.

5. Information exchange is performed in case of realization by means of the integrated system of general process within Union "Forming of the collection of the made provisional solutions of customs authorities of state members of the Eurasian Economic Union on classification of goods", the stipulated in Item 25th list of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of April 14, 2015 No. 29, according to the technological documents approved by the Commission.

6. Customs authorities provide submission to the Commission of up-to-date and reliable information.

II. Submission of information

7. Customs authorities no later than 30 working days from acceptance date of provisional solutions transfer in the automatic mode in the Commission information from provisional solutions which effective period did not expire which were not changed (were changed), not withdrawn and which are not terminated (according to Item 2 of Article 25 and Article 26 of the Customs code of the Eurasian Economic Union respectively).

8. Information shall contain the following data:

a) the description of goods (except for information, component the state, commercial, bank and protected by the law other secret (secrets), or other confidential information);

b) commodity code according to the CN FEA EEU;

c) code of state member in which the provisional solution, according to the qualifier of the countries of the world approved by the Decision of the Commission of the Customs union of September 20, 2010 No. 378 is made;

d) reasons for adoption of the provisional solution according to the Basic rules of interpretation of the Commodity nomenclature of foreign economic activity, notes to Sections, groups, subline items of the CN FEA EEU based on which the provisional solution was made;

e) expiry date of the provisional solution;

e) registration number of the provisional solution.

9. Information specified in Item 8 of this Procedure is created by customs authority according to the Procedure for filling of form of the provisional solution of classification of goods according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union and modification (amendments) of such provisional solution approved by the Decision of Board of the Eurasian economic commission of April 17, 2018 No. 58.
