Rules of check by the subject of fuel and energy complex of the data specified in article 10 of the Federal law "About Safety of Objects of Fuel and Energy Complex" concerning the physical persons performing the work which is directly connected with safety of objects of fuel and energy complex on the employment contracts or civil agreements signed with the subject of fuel and energy complex

1. These rules establish procedure for test the subject of fuel and energy complex of the data specified regarding 1 article 10 of the Federal law "About Safety of Objects of Fuel and Energy Complex" concerning the physical persons performing the work which is directly connected with safety of objects of fuel and energy complex (further respectively - objects, data), according to the employment contracts or civil agreements signed with such subject of fuel and energy complex (further - the checked face).

2. Check by the subject of fuel and energy complex of data concerning the checked faces is performed in case of the conclusion with them the employment contract or the civil agreement for work, direct connected with safety of objects.

3. For the admission to the work which is directly connected with safety of objects, the checked face represents in the form established by the subject of fuel and energy complex, the declaration that:

a) the checked face is not the person which stopped ahead of schedule powers on the state position or dismissed from public service including from law enforcement agencies, bodies of prosecutor's office or judicial authorities (further - public service), on the bases which are in accordance with the legislation of the Russian Federation connected with making of minor offense, rough or systematic misconduct, making of the offense discrediting honor of the government employee, loss of trust to it if after such early termination of powers or such dismissal there passed less than 3 years;

b) the checked face did not provide the false or incomplete information in case of employment, directly connected with safety of objects;

c) the checked face is not the foreign citizen, the citizen of the Russian Federation having nationality of foreign state either the residence permit or other document confirming the right to permanent residence of the citizen of the Russian Federation in the territory of foreign state or the stateless person.

4. After obtaining from the checked face of the declaration specified in Item 3 of these rules and in the presence the subject of fuel and energy complex has information on the facts of passing by the specified person of public service within 3 years preceding submission of the declaration, the subject of fuel and energy complex within 14 calendar days from the date of receipt of the declaration notifies relevant organ of the government, body of prosecutor's office or judicial authority that the checked face is planned to the admission to the work which is directly connected with safety of objects.

5. For confirmation of the fact of absence at the checked face of not removed or unspent conviction for making of intentional crime the checked face represents to the subject of fuel and energy complex the certificate of availability (absence) of criminal record and (or) the fact of criminal prosecution or of the termination of criminal prosecution. The checked face independently receives the specified reference in the procedure established by the legislation of the Russian Federation and submits it to the subject of fuel and energy complex in time, not exceeding 14 calendar days from the date of its obtaining.

6. For confirmation of the fact of absence at the checked face of mental disease, alcoholism or drug addiction the checked face represents the certificate of what does not stay on the registry in organizations of bodies of health care concerning mental disease, alcoholism or drug addiction. The checked face independently receives the specified reference in the procedure established by the legislation of the Russian Federation and submits it to the subject of fuel and energy complex in time, not exceeding 14 calendar days from the date of its obtaining.

7. For accomplishment by the subject of fuel and energy complex of these rules the checked face represents to the subject of fuel and energy complex consent to processing of its personal data.

8. The subject of fuel and energy complex after receipt of the documents specified in Items 3, of 5 and 6 these rules provides check of completeness and reliability of the data containing in them, in time, not exceeding 30 calendar days from the date of submission of the relevant documents.

9. By results of performed the subject of fuel and energy complex makes the decision on the admission or not admission of the checked face to the work which is directly connected with safety of objects.

10. The subject of fuel and energy complex once in 3 years performs, provided by these rules, concerning the checked faces which perform at it the work which is directly connected with safety of objects.
