Based on part three of subitem 6.2 of Item 6 of the Rules of realization of wood approved by the Presidential decree of the Republic of Belarus of November 23, 2020 No. 437, Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on accounting treatment for needs of legal entities and individual entrepreneurs in the wood on root realized from fund of regional executive committee, acceptance from them the corresponding requests, determination of the amounts of wood which are subject to realization out of the exchange biddings of release of such wood it (is applied).

2. This resolution becomes effective after its official publication and extends the action to the relations which arose since September 25, 2022.

Regulations on accounting treatment for needs of legal entities and individual entrepreneurs in the wood on root realized from fund of regional executive committee, acceptance from them the corresponding requests, determination of the amounts of wood which are subject to realization out of the exchange biddings, release of such wood

1. This Provision determines accounting treatment for needs of legal entities and individual entrepreneurs for the wood on root realized from fund of regional executive committee, acceptance from them the corresponding requests, determination of the amounts of wood which are subject to realization out of the exchange biddings, release of such wood.

2. Accounting of needs of legal entities and individual entrepreneurs for wood on root for the purposes determined in subitem 6.2 of Item 6 of Rules of realization of wood is performed based on their requests for the next year sent till October 1 of the year preceding year of realization of such wood to district executive committees, the Gorispolkoms, administrations of areas in the cities (further – executive committees) in the location of the legal entity or at the place of residence of the individual entrepreneur.

3. For the organization of accounting of needs of legal entities and individual entrepreneurs for wood on root and releases of such wood from fund of regional executive committee by the executive committee creates the commission and its structure affirms. The structure of the commission is determined by executive committee independently from number of persons employed and (or) representatives of other organizations.

During creation of the commission the chairman and the secretary of the commission are appointed.

The commission can be created on permanent basis or for certain period. The operating procedure of the commission is determined by the regulations approved by executive committee.

4. Legal entities and individual entrepreneurs give to the commission in time, specified in Item of 2 this provision, the request about the need for the wood on root realized from fund of regional executive committee in form according to appendix (further – the request).

Copies of the documents confirming possibility of use of such wood for the purposes, determined in subitem 6.2 of Item 6 of Rules of realization of wood are attached to the request.

5. When forming fund of regional executive committee the requests of legal entities and individual entrepreneurs submitted in time, specified in Item 2 this provision are considered.

6. Requests with indication of data on the legal entity or the individual entrepreneur are registered in incoming correspondence of executive committee.

Legal entities and individual entrepreneurs have the right before date of commission session in writing to withdraw the request.

If the legal entity or the individual entrepreneur withdraws the request before date of commission session, then it is considered not given about what the mark in incoming correspondence of executive committee becomes.

7. Commission session is held from October 1 to October 10.

Requests are considered according to the procedure of priority of their giving with the copies of the documents determined in part two of item 4 of this provision attached to them. The decision on inclusion of the amount of wood specified in requests of legal entities and individual entrepreneurs in the wood amount on root realized from fund of regional executive committee is accepted according to the procedure of priority of submission of requests in the amount of the unallotted amount of wood on root realized from fund of regional executive committee and is established in the amount of no more than 5 percent from settlement cutting area in the woods of forest fund which are under authority of the Ministry of forestry in proportion to groups of tree species.

The applications submitted by legal entities and individual entrepreneurs with violation of requirements of Items 2 and 4 of this provision and also in case of distribution of all amount of wood on root from fund of regional executive committee for the requests considered earlier are rejected.

8. Executive committees based on decisions of the commission till October 15 send to the relevant regional executive committees of the request with reasons for need of receipt of wood on root in the declared amounts.

Regional executive committees till October 25 send to the Ministry of forestry summary requests for realization of wood on root out of the exchange biddings with indication of required amounts.

9. The ministry of forestry considers the summary requests for realization of wood submitted by regional executive committees on root out of the exchange biddings for the next year and till November 10 introduces in accordance with the established procedure in Council of Ministers of the Republic of Belarus the draft of the resolution on wood sales amounts on root out of the exchange biddings.

10. Regional executive committees within 10 days after adoption by Council of Ministers of the Republic of Belarus of the resolution specified in Item 9 of this provision inform executive committees on wood sales amounts on root.

Regional executive committees based on the actual use of funds taking into account the purposes determined in subitem 6.2 of Item 6 Corrected wood realization, had the right to redistribute wood amounts on root between executive committees proceeding from the developed priority of submission of requests from the legal entities and individual entrepreneurs registered in incoming correspondence of executive committee.
