1. Approve Regulations on procedure for attraction of non-paid assistance to the sphere of support and development of mass media according to appendix.

2. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 01.11.2012 No. 313

3. To impose control over the implementation of this resolution on deputy prime ministers of the Republic of Uzbekistan Aripova A. N. and Azimova R. S.

Regulations on procedure for attraction of non-paid assistance to the sphere of support and development of mass media

I. General provisions

1. This Provision determines procedure for attraction of non-paid assistance to the sphere of support and development of mass media for the purpose of ensuring economic independence of mass media of the Republic of Uzbekistan (further - media).

2. In the field of support and development of media (further - non-paid assistance) are understood as non-paid assistance:

financial and other donations of legal entities and physical persons;

financial resources and property within technical assistance, grants and other free aid of the organizations, including payment of the expenses connected with trips, and also trainings, seminars, conferences held in the territory of the Republic of Uzbekistan and abroad;

non-paid rendering services, performance of works.

Mass media are understood as the form of periodic distribution of mass information having the permanent name and which is published or aired (further - release) at least once in six months, in printing (newspapers, magazines, sheets, bulletins, etc.) and (or) electronic type (TV, radio - film, video programs, Internet editions, etc.), and other forms of periodic distribution of mass information.

The editorial office of mass media is understood as the legal entity or structural division of the legal entity performing release of mass media.

II. Rules of attraction of financial resources

3. Mass media's editorial offices have the right to non-paid assistance from the legal entities and physical persons, except as specified, established in item 4 of this provision.

4. Provision directly to mass media's editorial offices of non-paid assistance is not allowed:

foreign states;

legal entities of foreign states, their representations and branches;

international organizations, their representations and branches;

legal entities in whose authorized fund the share of foreign investments constitutes thirty percent and more;

foreign citizens;

the persons without citizenship who are constantly not living in the Republic of Uzbekistan;

the religious organizations, except as specified their participations in authorized fund of the legal entity - mass media's editorial office;

anonymous persons or persons under pseudonym.

The specified categories of persons have the right to render assistance to mass media's editorial offices through Public fund of support and development of independent printing mass media and news agencies of Uzbekistan.

5. The amount of means of the non-paid assistance received by mass media's editorial offices from one source of assistance within year (in case of assistance in kind - in case of its recalculation in terms of money), shall not exceed 35 percent from the total amount of annual costs according to the approved profit and loss budget of edition.

The mass media's editorial office within a month from the date of receipt of means of non-paid assistance shall return the amount exceeding the established size, to person who rendered assistance.

Return of the amount of means exceeding the established size is performed by transfer to the settlement account of person who rendered assistance. In case of impossibility of return this amount is transferred into the settlement account of Public fund of support and development of independent printing mass media and news agencies of Uzbekistan.

In need of return of part of the non-paid assistance received in kind (after its recalculation in terms of money), the editorial office contributes the corresponding property to Public fund of support and development of independent printing mass media and news agencies of Uzbekistan which uses it for the purpose of implementation of the authorized activities.

The costs necessary for release of media are determined according to Regulations on structure of costs by production and sales of products (works, services) and about procedure for forming of financial results, the approved resolution of the Cabinet of Ministers of the Republic of Uzbekistan of February 5, 1999 N54.

6. Mass media's editorial offices use non-paid assistance strictly for the purpose of implementation of the authorized activities.

Use of non-paid assistance for other purposes is forbidden.

7. Intervention of the legal entities and physical persons rendering non-paid assistance on development and support of media in creative activities of editions is not allowed.

8. Legal entities of the Republic of Uzbekistan by provision of donations in the form of money transfer them into the settlement account of mass media's editorial office in authorized bank, with indication of the details provided by rules of clearing settlements for legal entities.

9. Citizens of the Republic of Uzbekistan by provision of donations in the form of money transfer them into the settlement account of mass media's editorial office in authorized bank, with presentation of the civil passport or the document replacing it and specifying in the payment document of the surname, name, middle name and other passport data.

10. Rendering non-paid assistance to mass media's editorial offices by direct transfer of cash is not allowed.

III. Accounting and control

11. For the purpose of providing open entry of the public and state bodies of the Republic of Uzbekistan to information on obtaining and use of non-paid assistance in the field of support and development of media, the editorial office of the relevant media:

quarterly publish in periodic printing editions of the Republic of Uzbekistan data on amount and sources of receipt of non-paid assistance (in case of obtaining);

in the terms established by the legislation and procedure submit reports on the established form of receipt and expenditure of non-paid assistance in the accounting period in bodies of the State Tax Service.
