About approval of the Regulations on hiring of division managers of the state suppliers of medical services on competitive basis

According to provisions of Art. 56 of the Labor code of the Republic of Moldova, for the purpose of regulation of the procedure of employment, candidate screen to position of the division manager and equal access to vacancies, based on rules of the Regulations on the organization and functioning of the Ministry of Health approved by the Order of the Government No. 148/2021, of PRIKAZYVAYU:

1. Approve Regulations on hiring of division managers of the state suppliers of medical services on competitive basis (appendix).

2. To provide to heads of the state suppliers of medical services:

1) carrying out tender only according to requirements of the Provision approved by this order;

2) the organization of personnel training of personnel department for holding the actions connected with tender;

3) placement of vacant positions on the web page of organization and other information resources.

3. To management of management of medical personnel:

1) to monitor observance of rules of this provision in case of employment of division managers of the state suppliers of medical services;

2) to give methodical help to the state suppliers of medical services in application of the approved Provision.

4. Publish this order in the Official monitor of the Republic of Moldova.

5. Declare invalid the Order of the Ministry of Health No. 139 of couples. 3 of 15.10.2015 "about approval of the Regulations on hiring of medical personnel of health care system on competitive basis".

6. To impose control of execution of this order on the state secretary Mrs. Zinaida Bezverkhni.

Regulations on hiring of division managers of the state suppliers of medical services on competitive basis

I. General provisions

1. The regulations on hiring of division managers of the state suppliers of medical services on competitive basis (further - the Provision) are developed according to Art. 56 of the Labor code No. 154-XV of 28.03.2003, the Law on health protection No. 411 of 28.03.1995, and are aimed at providing equal access for candidates to positions of division managers taking into account the characteristic of position and professional competence of candidates.

2. The principles provided by this Provision extend to the state suppliers of medical services in the course of enrollment, selection and employment of division managers.

3. Enrollment, selection and employment of division managers will be organized and carried out based on the following principles:

open competition - ensuring open and equal entry to all candidates who correspond to the established conditions;

transparency - complete informing on vacancies and conditions of employment, providing information on the organization and carrying out tender to all concerned parties;

objectivity - creation of equal conditions to candidates for vacant position;

meritocracy - selection on the basis of the received results on merits of the most competent persons.

II. Organization of tender

4. Occupation of free or temporarily free position of the division manager (the department head, departments, laboratories) the state suppliers of republican, city and district medical services (further - organizations) is held on competitive basis, within vacant or temporarily the vacant positions provided by the staff list.

5. Any person corresponding to the general and specific terms established by the corresponding job description can participate in tender on occupation of vacant or temporarily vacant position.

6. The specific conditions relating to the education necessary for occupation of vacant or temporarily vacant position are determined according to classifications of industries and the approved specialties.

7. At least in 15 days until the beginning of tender the organization organizing tender provides advertizing of the held competition by means of the announcement.

8. Competition is announced through mass media and is placed on bulletin board of organization, on the web page of organization and, if necessary, on the web page of the founder.

9. The announcement shall contain:

a) the name and the location of the organization organizing tender;

b) the job title on which competition is organized;

c) the job description of the position exposed on tender;

d) general and specific terms of participation in tender;

e) contents of the file of the participant in tender;

f) deadline of submission of the file;

g) method of submission of the file (personally or through e-mail);

h) phone, address, e-mail address and contact person responsible for provision of the additional information and acceptance of the file.

III. Registration of candidates

10. On participation in tender on occupation of vacant or temporarily vacant position any persons answering to the following general terms can be registered:

a) are citizens of the Republic of Moldova;

b) the citizens of other countries taking the residence and the work permit in the Republic of Moldova;

c) know Romanian, written and oral;

d) are in condition of full legal capacity;

e) with corresponding for position for which apply the state of health confirmed with the medical certificate issued by the family doctor or authorized medical institution;

f) were not condemned for crime execution, incompatible with position for which apply;

g) have the corresponding education, stipulated by the legislation for this position;

h) correspond to specific conditions for holding the post, exposed on tender, and working life at least 3 years.

11. For registration for tender candidates shall give by e-mail or personally the file, containing the following documents:

a) statement for participation in tender;

b) copy of the identity document;

c) copies of diplomas about education and other documents confirming passing of specialization or trainings;

d) the copy of the certificate certifying working life and, if necessary, years of service in the specialty;

e) the statement under the responsibility for lack at it of the criminal records incompatible with position for which the candidate applies;

f) the health certificate certifying the state of health;

g) curriculum vitae;

h) the copy of the marriage certficate or the copy of the documents certifying change of surname if the candidate changed the surname;

i) recommendation.
