About approval of some regulatory legal acts concerning the organization of special training of workers of road transportation of dangerous goods

According to article 16 of the Law of Ukraine "About transportation of dangerous goods", to the Law of Ukraine "About accession of Ukraine to the European Agreement on the international road delivery of dangerous goods (RDDG)", to item 4 of the Procedure for carrying out the special training of workers of subjects of transportation of dangerous goods approved by the resolution of the Cabinet of Ministers of Ukraine of October 31, 2007 No. 1285, for the purpose of reduction of regulatory legal acts of the Ministry of Internal Affairs of Ukraine in compliance with the legislation of PRIKAZYVAYU:

1. Approve enclosed:

1) Requirements to the centers of special training of the transport drivers transporting dangerous goods, and authorized on safety issues of transportations of dangerous goods by highways;

2) the Procedure for examination, registration and issue of certificates DPOG on training of the transport drivers transporting dangerous goods, certificates on training of representatives for safety issues of transportations of dangerous goods by highways.

2. Declare invalid the order of the Ministry of Internal Affairs of Ukraine of March 21, 2008 No. 130 "About safety control of transportation of dangerous goods by road transport", registered in the Ministry of Justice of Ukraine on April 15, 2008 for No. 309/15000 (with changes).

3. To the main service center Ministry of Internal Affairs () provide to Moiseenko E. submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

4. This order becomes effective since January 1, 2023, but not earlier than day of its official publication.

5. To impose control of execution of this order on the deputy minister according to distribution of duties.

Requirements to the centers of special training of the transport drivers transporting dangerous goods, and authorized on safety issues of transportations of dangerous goods by highways

I. General provisions

1. These Requirements establish procedure for determination, inspection and registration of the centers of special training of the transport drivers transporting dangerous goods, and authorized on safety issues of transportations of dangerous goods by highways (further - the center of special training), requirements to their educational and methodical, to material and technical resources and teachers, and also to the organization of carrying out special training of the transport drivers transporting dangerous goods (further - drivers), and the transportations of dangerous goods by highways authorized on safety issues (further - representatives).

2. The terms used in these Requirements have such value:

special training - training in the centers of special training in basic course of training and/or specialization courses of preparation for transportation in tanks, on transportation of substances and products of class 1, on transportation of radioactive materials of class 7, or at the rate of retraining of drivers (further - rate of preparation/retraining of drivers), and also special training in course of training of the representative;

the representative for safety issues of transportations of dangerous goods by highways - person (the consultant of safety of transportation of dangerous goods) who underwent special training passed examination, has the valid certificate on training of the representative and performs the functions determined in subsection 1.8.3.3 of Section 1.8.3. Chapter 1.8 of part of 1 appendix A to the Agreement on the international road delivery of dangerous goods (DOPG), subjects have transportations of dangerous goods, irrespective of their patterns of ownership and form of business performing road transportation of dangerous goods or carry out the transactions connected with transportation on sending, packaging, loading, filling or unloading of dangerous goods.

Other terms are used in the values given in appendix A, B to the Agreement on the international road delivery of dangerous goods (DOPG) of September 30, 1957, the Law of Ukraine "About transportation of dangerous goods" and other regulatory legal acts.

3. To drivers and candidates for representatives the center of special training in results of successful passing of special training grants the certificate on the end of special training which form is given in appendix 1 to these Requirements.

Data on the granted certificate on the end of special training instantly are entered by the authorized employee of the center of special training in the Unified state register of the Ministry of Internal Affairs (further - EGR Ministry of Internal Affairs).

The certificate on the end of special training does not grant the right to vehicle control which transports dangerous goods, and accomplishment of functions of the representative.

4. Drivers undergo special training in such rates of preparation/retraining of drivers:

on basic course of training according to requirements of Item 8.2.1.2 of Section 8.2.1 of Chapter 8.2 of part 8 of appendix B to DOPOG covering, at least, the subjects specified in Item 8.2.2.3.2 of subsection 8.2.2.3 of Section 8.2.2 of Chapter 8.2 of part 8 of appendix B to DOPOG;
