Chapter 1. Basic provisions

Article 1. Subject of regulation of the Law

1. This Law governs the relations connected with registration of grades and hybrids of the plants having permission to use with production, reproduction, certification, transportations, storage, realization and use of grades, planting stock.

2. This Law extends to seeds and planting stock of all types of the local and imported cultures, ornamental plants, wild-growing field fodder and forest plants intended for production or reproduction.

3. This Law is not applicable in case of registration of the grades and hybrids received by means of genetic engineering and which are considered as gene-modified organisms, productions, reproductions, certifications, transportations, storages, realization and uses of seeds and planting stock.

Article 2. Legislation of the Republic of Armenia on seeds and planting stock

1. The legislation of the Republic of Armenia on seeds and planting stock consists of this Law and other laws and legal acts of the Republic of Armenia.

2. If international treaties of the Republic of Armenia establish other provisions, then provisions of international treaties are effective.

Article 3. Main objectives of production of seeds and planting stock

1. Enters the main objectives of production of seed farming and production of planting stock:

1) creation and development of almost applicable production systems and reproduction of seeds of cultures, planting stock;

2) preserving and reproduction economically and biologically valuable properties of grades of cultures and forms of planting stock in the course of strain renovation, strain changing and strain testing;

3) the accelerated reproduction of new grades or hybrids of the cultures and new forms of planting stock which are well adapted for climatic conditions of the Republic of Armenia;

4) preserving and reproduction of genetic inventories widespread in the Republic of Armenia, native and rare grades and forms of planting stock;

5) the organization of seed farming and production of planting stock using scientific methods;

6) creation of the modern information bases promoting development of seed farming and production of planting stock.

Article 4. The basic concepts used in the Law

1. In this Law the following basic concepts are used:

1) seed – the generative organ bearing heredity of plant, used for the purpose of preserving and reproduction of grades;

2) planting stock – affiliated plants long-term (some one-year) plants, received by application of methods of vegetative or seed propagation;

3) seedling production – the crop production industry which is engaged in reproduction of planting stock of plants using different methods and methods;

4) seed farming – the crop production industry which is engaged in mass reproduction of seeds of regionized varieties for the purpose of implementation of strain renovation and strain changing;

5) preliminary (original) seeds – the seeds made by the selector or person keeping grade, conforming to requirements of the technical regulations existing in the field of seed farming, the state criteria and other regulating documents, the features of this grade which are completely bearing in themselves;

6) basic (supeelitny, elite) seeds (superelite, elite) – the seeds received from original seeds, conforming to requirements of the technical regulations existing in the field of seed farming, the state criteria and other regulating documents;

7) reproductive seeds – the seeds received from basic seeds, conforming to requirements of the technical regulations existing in the field of seed farming, the state criteria and other regulating documents;

8) hybrid seeds – seeds of the first generation (F 1) received by crossing of different parent forms, conforming to requirements of the technical regulations existing in the field of seed farming, the state criteria and other regulating documents;

9) initial (original) planting stock of perennial plants – parts of grades, clones or the whole virus-free plants received as a result of selection works for the purpose of preserving and further reproduction of heredity of female plants;

10) basic (superelite, elite) planting stock of perennial plants – the whole virus-free plants or parts of grades and clones intended for plantations and received as a result of consecutive reproduction of initial planting stock;

11) the certified planting stock of perennial plants – the most virusogenny whole plants checked for bezvirusnost intended for creation of production gardens and bearing invariable heredity of the grade received from vegetative propagation of basic planting stock;

12) reproductive planting stock of perennial plants – the whole plants received from the vegetative propagation including three consecutive generations of the certified planting stock of perennial plants, and checked for bezvirusnost (lack of the most virusogenny activators);

13) ordinary (regular) planting stock of perennial plants – the whole plants received from vegetative propagation of third and the subsequent reproductions of the certified planting stock of perennial plants, not subjected to improvement and check;

14) the state testing of cost efficiency – the field and laboratory complex trials which are carried out by authorized body for the purpose of determination of distinctive feature, uniformity, stability of plant varieties, their adaptability to climatic conditions of the republic, their cost efficiency in comparison with well-known grades in zone (zones) of cultivation;

15) the grade having permission to use – the grade which passed the state tests for cost efficiency, registered in the list of the grades having permission to use;

16) priority of production of seeds – the complex governed, the instructions, instructions and guarantees applied for the purpose of production and certification of seeds of the grades registered in the list of the seeds having permission to use of this type of plant;

17) priority of seedling production – the complex governed, the instructions, instructions and guarantees applied for the purpose of production and certification of planting stock of the grades registered in the list of the seeds having permission to use of this type of plant;

18) primary link of seedling production – plantations and gardens of choice grades (collection) long-term cultures which are framed for the purpose of preserving, studying and further reproduction of heredity of female plants with initial planting stock of the grades registered in the main nurseries;

19) certification of seeds and planting stock – complex of the actions (field trials, laboratory researches) established for the purpose of determination of high-quality accessory of seeds and planting stock, compliance of sowing qualities of seeds and commercial properties of planting stock to requirements of technical regulations, the state criteria, other regulating documents existing in the field of seed farming and production of planting stock;
