No. 193-203, 413), with subsequent changes, the item b-1) of h (1) Art. 14 and h (2) Art. 36 of the Law No. 10/2016 on promotion of energy use from renewable sources (The official monitor of the Republic of Moldova, 2016, Art. No. 69-77, 117), with subsequent changes, DECIDES: Administrative board of the National agency on regulation in power

1. Approve Regulations on measurement of electrical energy for commercial purposes, according to appendix No. 1.

2. Declare invalid the Regulations on measurement of electrical energy for commercial purposes approved by the Resolution of Administrative board of the National agency on regulation in power No. 382 of July 2, 2010. (The official monitor of the Republic of Moldova, 2010, the Art. No. 214-220, 765) registered in the Ministry of Justice at No. 779 of October 28, 2010.

3. Approve changes which are made to some regulations approved by NARE according to appendix No. 2.

4. To impose control of execution of this resolution on divisions of the National agency on regulation in power.

Regulations on measurement of electrical energy for commercial purposes

Part 1 Purpose and scope

1. The regulations on measurement of electrical energy for commercial purposes (further - the Provision) establish the principles and conditions on which measurement for the commercial purposes of quantities made, imported, exported, transited, transported, distributed, delivered and the consumed electrical energy shall be performed.

2. This Provision is applied without discrimination to producers, system operators, suppliers and final consumers in the legal relationship arising in connection with the measuring equipment for accounting of quantity of electrical energy for commercial purposes in the wholesale and retail market of electrical energy, including in case of issue of permissions to connection to power network, in case of installation and operation of the measuring equipment. The measuring equipment intended for measurement of quantity of electrical energy in the technical purposes is not the this provision subject.

3. This Provision establishes rules of measurement:

1) quantities of the electrical energy delivered and consumed in/from power network by power plants;

2) quantities of the electrical energy arriving in/from the transferring power network;

3) quantities of the electrical energy arriving

and leaving distribution power network;

4) quantities of the electrical energy imported, exported and transited on electric utility system;

5) quantities of electrical energy in exchange points between distribution power networks;

6) quantities of the electrical energy delivered to final consumers.

4. In this Provision the terms determined in the Law on the electric power No. 107/2016, the Law on metrology No. 19/2016, the Law on energy efficiency No. 139/2018, the Rules of the market of electrical energy approved by National regulation agency in power (further - the Agency), and also the following terms and determinations are used:

activities for measurement of electrical energy - set of the actions (actually measurement, removal of indications of the measuring equipment, data collection about indications of the measuring equipment, management of the database about the measuring equipment and submission of information on measurement of electrical energy) performed by the producer, system operators and the supplier in connection with measurement and registration of quantities of electrical energy;

category of points of measurement - measurement points for which the Provision establishes separate technical requirements;

the counter of electrical energy - the electric device intended for measurement of quantity of the electrical energy passing on specific chain;

the control counter of electrical energy - the counter of electrical energy established for measurement of the same sizes as the commercial counter of electrical energy, for the purpose of check of correctness of registration of the commercial counter of electrical energy;

measurement point - the place in electric utility system or the place located on intersystem connections where for the commercial purposes measurement of quantity made is performed transported, imported, exported, transited, delivered and the consumed electrical energy;

the automated system of accounting - set of the equipment providing measurement for the commercial purposes of quantity made, transported, imported, exported, transited, delivered and the consumed electrical energy, and also providing automatic collection of meter readings of electrical energy, accumulating and preserving these data in the database and possibility of information transfer;

the last reading indications of the measuring equipment - the last removal of indications of the measuring equipment by the representative of system operator with its physical presence at installation site of the measuring equipment as a result of which there are documentary confirmations of indications of the measuring equipment.

Part 2 Rights, obligations and responsibility concerning activities for measurement of electrical energy

5. Activities for measurement of electrical energy are performed by the producer, the system operator and the supplier. The final consumer has the right to participate in measurement of electrical energy.

6. The measuring equipment used in the course of measurement of electrical energy for commercial purposes shall conform to the requirements established in the Law on metrology No. 19/2016 and in the Technical regulation about ensuring presence in the market of measuring instruments approved by the Order of the Government No. 408/2015.

7. Depending on the directions of flows of electrical energy or from network to which electroinstallations of consumption of final consumers are connected the following categories of points of measurement of electrical energy are established:

Category A: Points of measurement of quantity of the electrical energy delivered in the transferring or distribution power supply network from power plants.

Category B: The point of measurement of quantity of the electrical energy imported, exported and transited on electric utility system, measurement point on intersystem connections with other electric utility systems and points of measurement of quantity of the electrical energy arriving in the distribution power supply network from the transferring power supply network.

Category C: Points of measurement of quantity of the electrical energy delivered to final consumers whose electroinstallations of consumption are directly connected to the transferring power supply network, irrespective of the rated voltage of power network in point of connection or from the primary/secondary tension of the power transformer.

Category D: Points of measurement of quantity of the electrical energy delivered to final consumers whose electroinstallations of consumption are connected to the distribution power supply network of 6 kV and above or which are owners or own power plants or transformer substations.

Category E: Points of measurement of quantities of the electrical energy delivered to final consumers whose electroinstallations of consumption are connected to the distribution power supply network, except for those which enter category D.

8. For confirmation of transaction with electrical energy in the market of electrical energy, it is necessary to provide measurement of the following quantity of electrical energy, without being limited to it:

1) delivered in power network from power plant and from production units of the producer;

2) used for own and economic needs (separately) for power plants and transformer stations;

3) delivered to final consumers on direct electric lines from tires of power plants;

4) arrived in the transferring or distribution power supply network;

5) delivered to final consumers whose electroinstallations of consumption are connected to the transferring or distribution power supply networks;

6) transmitted through transit lines (in each direction separately);

7) imported;

8) exported.

9. Due to the measurement of electrical energy the producer, the operator of the transferring system and the operator of distributive system incur the following obligations:

To provide 1) in all points of measurement established in power supply networks, equipment legitimized, metrological the attorney who is present at the market by the measuring equipment according to requirements of this provision, the Law on metrology No. 19/2016, of the Technical regulation on ensuring the presence in the market of measuring instruments approved by the Order of the Government No. 408/2015, and to use the personnel trained according to accomplishment of specific obligations;

2) to provide configuring, installation, metrological checking, and also operation of the measuring equipment according to requirements of this provision, the Law on the electric power No. 107/2016, of the Law on metrology No. 19/2016, of the Law on energy efficiency No. 139/2018 and the Official list of the gages and measurements which are subject to legislative metrological control, the approved Order of the Government No. 1042/2016;

3) timely to carry out metrological checking of gages of the electrical energy delivered to the residential customer;

4) to provide measurement of all necessary parameters depending on category of points of measurement;

5) to provide equipment of points of measurement with the measuring equipment of class of accuracy specified for the category of points of measurement established by this Provision;

6) to provide information access from the database of the measuring equipment in accordance with the terms of this provision;
