RESOLUTION OF THE CABINET OF MINISTERS OF THE KYRGYZ REPUBLIC

About payment terms of work of employees of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and State broadcasting company of the Kyrgyz Republic of "ELTR"

For the purpose of implementation of the Law of the Kyrgyz Republic "About National telebroadcasting corporation of the Kyrgyz Republic", the Presidential decree of the Kyrgyz Republic "About some measures for reforming of National telebroadcasting corporation of the Kyrgyz Republic" of August 3, 2022 270, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides No.:

Approve:

1) Regulations on payment terms of work of employees of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR" according to appendix 1;

2) Standard states of administrative and managerial, creative and production, technological and junior service personnel of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions according to appendix 2;

2-1) Standard states of administrative and managerial, creative and production, technological and junior service personnel of the State broadcasting company of the Kyrgyz Republic of "ELTR" according to appendix 2-1;

3) frequency rate coefficients to official pay rates of employees of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR" according to appendix 3;

4) qualification requirements for workers of system of TV and radio broadcasting according to appendix 4;

5) the sizes of length-of-service allowances to official pay rates of employees of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR" according to appendix 5;

6) the size of monthly length-of-service allowance to the technical and junior service personnel occupied in National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR" according to appendix 6.

2. Establish:

1) the minimum base rate in the amount of 7040 som, the National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions which is the basis for calculation of official pay rates of workers and the State broadcasting company of the Kyrgyz Republic of "ELTR";

2) allowances for manifestation of creative and professional initiative, high qualification at the rate to 50 percent of official pay rate. The expenses connected with introduction of the specified allowance are made within the approved salary fund of employees of the telebroadcasting organizations;

3) percentage allowances to official pay rates of the following workers, from among technical and junior service personnel, in the following sizes:

- to drivers of cars for irregular working hours - 25 percent of official pay rate;

- to watchmen for work at night - 50 percent of the hour tariff charge;

- to cleaners of service premises, public toilets for work using synthetic washing and disinfectants - 25 percent of official pay rate.

3. Determine what is paid to administrative and management personnel of National telebroadcasting corporation of the Kyrgyz Republic:

1) in case of exit in labor leave benefit for improvement in the amount of two-month salary fund;

2) at the end of the calendar year the thirteenth salary in the amount of average monthly salary fund.

4. Bring in the order of the Government of the Kyrgyz Republic "About allowances to official pay rates of employees of the public institutions and organizations having the status "national" or honorary title No. 239, "academic" from May 24, 2011, the following change:

in the List of the public institutions and organizations having the status "national" or honorary title "academic", approved by the above-stated resolution:

- add with Item 34 following of content:

"34. National telebroadcasting corporation of the Kyrgyz Republic.".

5. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 12.12.2023 No. 667

6. Bring in the order of the Government of the Kyrgyz Republic "About approval of qualification requirements for employees of cultural institutions, art, information and cinematography" of May 29, 2020 No. 278 the following changes:

The subitem 6 of Item 1 to state 1) in the following edition:

"6) Public regional broadcasting company "Yntymak" and the regional editorial offices of newspapers according to appendix 6;";

Appendix 6 to the above-stated resolution to state 2) in edition according to appendix 8 to this resolution.

7. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 24.07.2023 No. 367

8. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About payment terms of work of employees of cultural institutions, arts, information and sport" of March 30, 2022 No. 185 the following changes:

in the Regulations on payment terms of work of employees of cultural institutions, art, information and sport approved by the above-stated resolution:

- in Item 16 shall be replaced with words the word of "media centers" "the editorial offices of newspapers";

- the paragraph the fourth ceased to be valid according to the Resolution of the Cabinet of Ministers of the Kyrgyz Republic of 12.12.2023 No. 667

9. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About introduction of new wages system of employees of Public telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR" of May 31, 2011 No. 266;

2) the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of March 13, 2017 No. 149;

3) Item 5 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About payment terms of work of the workers who are not belonging to the category of the government employees and occupied in the public subordinated institutions in the sphere of culture and information" of March 30, 2022 with No. 180.

10. To the Ministry of Culture, information, sport and youth policy of the Kyrgyz Republic to take the necessary measures following from this resolution.

11. To the Ministry of Finance of the Kyrgyz Republic to take the adequate measures following from this resolution including on introduction in accordance with the established procedure of changes in the Law of the Kyrgyz Republic "About the republican budget of the Kyrgyz Republic for 2022 and the forecast for 2023-2024".

12. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

13. This resolution is subject to official publication and becomes effective since November 1, 2022.

Regulations on payment terms of work of employees of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and State broadcasting company of the Kyrgyz Republic of "ELTR"

1. General provisions

1. This Provision regulates compensation of employees of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR".

2. In this Provision the following concepts are applied:

the official pay rate is the fixed amount of compensation of workers for execution of job responsibilities of certain complexity for calendar month, without the compensatory, stimulating and social payments;

the salary is remuneration for work depending on qualification of the worker, complexity, quantity, quality and conditions of the performed work, works at night, output and non-working holidays, and also payments of the compensatory and stimulating nature. Payments of the compensatory and stimulating nature in the form of allowances and surcharges are established in absolute values or as a percentage to basic salary;

compensation payments are the money payments established for the purpose of compensation to workers of the costs connected with execution of labor or other stipulated by the legislation obligations by them in case of combination of professions, works outside the normal duration of working hours in special conditions, the mountain and remote zones, the work having portable character;

the stimulating payments are the awarding and payments directed to stimulation of the worker to achievement of higher production indicators, increase in professional skill, labor productivity and also for rank "Deserved" and "National", performance of works of various qualification;

the length of service is period of time during which the worker carried out professional activity in system of TV and radio broadcasting;

standard states are limit rate of streamlining of the number of staff of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR".

3. The sizes of the minimum base rate and coefficients of frequency rate to official pay rates are established by the resolution of the Cabinet of Ministers of the Kyrgyz Republic.

4. The salary of workers is estimated taking into account accomplishment of regulation of working hours. The size of the salary is determined proceeding from basic salaries, taking into account payments of the compensatory and stimulating nature. The sizes and procedure for application of district coefficients for work in the mountain and remote areas, for unrationed working conditions, and also other payments to workers which are not specified in this Provision are established according to the legislation of the Kyrgyz Republic in the sphere of compensation.

The salary includes:

- the guaranteed part:

official pay rate;

length of service;

- compensation payments;

- the stimulating allowances.

5. Heads of National telebroadcasting corporation of the Kyrgyz Republic, its subordinated divisions and the State broadcasting company of the Kyrgyz Republic of "ELTR", if necessary, can apply contractual form of hiring of workers over the established extreme number at the expense of special means and the income, including on piece-work pay.

2. Compensation payments to basic salaries

6. In system of TV and radio broadcasting compensation payments to basic salaries of all workers of TV and radio broadcasting taking into account conditions, specifics of work are established.
