About the oncological help

This Law establishes the legal basis of rendering the specialized medical and public assistance to oncological patients.

Chapter I. General provisions

Article 1. Basic concepts

1.0. The basic concepts used in this Law mean the following:

1.0.1. the oncological help - the scientific and medical measures directed to timely detection, prevention, inspection and treatment of malignant tumors;

1.0.2. the oncological patient - completely examined person at whom morphological methods confirm the diagnosis of malignant tumor;

1.0.3. oncology - the field of medicine and biology studying origins, development mechanisms, clinic, diagnostics, treatment and prevention of malignant tumors;

1.0.4. malignant tumor - the education having infiltrative growth expanding, sprouting in surrounding fabrics, destroying them and capable to metastasis;

1.0.5. the oncologist - the specialist doctor who received preparation on oncological specialty;

1.0.6. terminal stage - reducing functions of organism of the oncological patient to biological death;

1.0.7. cytologic inspection - microscopic research of cellular elements in the medicines received from bodies and fabrics.

Article 2. Legislation of the Azerbaijan Republic on the oncological help

The legislation of the Azerbaijan Republic on the oncological help includes the Constitution of the Azerbaijan Republic, the Law of the Azerbaijan Republic "About public health care", this Law, other regulatory legal acts and the international agreements which the Azerbaijan Republic joined.

Article 3. Law scope

This Law extends to citizens of the Azerbaijan Republic, to the foreigners who are constantly living in the territory of the Azerbaijan Republic on stateless persons, and also to all physical persons and legal entities which are engaged in prevention and treatment of oncological diseases irrespective of their form of business.

Article 4. The treatment-and-prophylactic actions directed to decrease in oncological diseases, and the principles of their implementation

4.1. The treatment-and-prophylactic measures directed to decrease in oncological diseases provide preventive, diagnostic, medical and rehabilitation actions.

4.2. The treatment-and-prophylactic measures directed to decrease in oncological diseases are performed according to the procedure, established by relevant organ of the executive authority.

4.3. The oncological patient who is citizens of the Azerbaijan Republic, medical care in the public medical institutions is performed at the expense of the government budget.

4.4. Inspection and treatment of the foreigners who are constantly living in the territory of the Azerbaijan Republic of stateless persons in oncological organizations is performed on paid basis, and emergency oncological aid is given at the expense of means of the government budget.

Chapter II. Measures of the guaranteed government assistance the oncological patient

Article 5. Types of actions of the guaranteed government assistance the oncological patient

5.0. For the purpose of assistance to oncological patients the state guarantees the following:

5.0.1. acceptance and implementation of target state programs on decrease in oncological diseases;

5.0.2. approval of amount and the quality standards (according to the international requirements) the medical care provided to oncological patients;

5.0.3. creation of specialized public medical institutions, the structures of oncological service performing medical examination, inspection, treatment and rehabilitation of oncological patients, and strengthening of their material and technical resources;

5.0.4. implementation of the preventive measures directed to decrease in oncological diseases;

5.0.5. conducting examinations in connection with oncological disease;

5.0.6. complete satisfaction of need for medical and diagnostic supply and medicines of outstanding performance, including in narcotic and not narcotic soothing medicines;

5.0.7. use of medicines to destination and ensuring transparency in this area;

5.0.8. creation of conditions for international cooperation in the field of fight against oncological diseases;

5.0.9. legal advice bureaus in connection with oncological diseases;

5.0.10. carrying out scientific research in the field of oncology, coordinating of activities of physical persons and legal entities in the field and implementation of methodical actions;

5.0.11. preparation and advanced training of medical specialists in treatment of oncological diseases;

5.0.12. the state ensuring content of the oncological patients who are at the last stage of oncological disease and lost social communications in medical institutions of general purpose, for necessary term.

Article 6. Delivery of health care by the oncological patient

6.1. Oncological patients are provided with medical care which amounts and the quality standards are established by relevant organ of the executive authority.

6.2. Measures of out-patient and polyclinic medical care by the oncological patient, stationary and out-patient treatment, and also actions for rehabilitation and medical examination are performed according to the procedure, established by relevant organ of the executive authority.

6.3. Medical and diagnostic help to oncological patients is given in specialized oncological agencies according to the individual address or based on the direction of treatment and prevention facility.

6.4. Treatment of oncological patients is performed based on written consent of patients or members of their family.

6.5. Treatment of the oncological patients who did not reach age of 18 years is performed based on written consent of their parents or legal representatives.

6.6. In case of serious threat for life and health of oncological patients, the corresponding treatment can be carried out without written consent.

6.7. Providing oncological patients with medicines is performed according to the procedure, established by relevant organ of the executive authority.

6.8. The list and amount of medicines, including the narcotic and not narcotic soothing medicines emitted annually for treatment of oncological patients are determined by relevant organ of the executive authority.

Article 7. Prevention of oncological diseases

7.0. Prevention of oncological diseases is performed as follows:

7.0.1. obligatory carrying out primary physical examination of workers of heavy, harmful and dangerous productions in case of execution of an employment agreement, and in subsequent carrying out periodic obligatory physical examination;

7.0.2. detection, capture on accounting and medical examination for the purpose of treatment of persons in whom precancer diseases and early forms of cancer are found;
