1. Approve:

1) Rules of submission by bodies of state revenues to Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan of the data which are tax secret without receipt of the written permission of the taxpayer (tax agent) and confidential information, according to appendix 1 to this joint order;

2) the List of the represented data which are tax secret without receipt of the written permission of the taxpayer (tax agent) and confidential information, according to appendix 2 to this joint order.

2. To provide bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) the direction of the copy of this joint order in the state and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan.

3. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan placement of this joint order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

4. Repeal the joint order of the Chairman of the Agency of the Republic of Kazakhstan according to the statistics of September 28, 2011 No. 278 and the Minister of Finance of the Republic of Kazakhstan of January 10, 2012 No. 8 "About approval of the List of information about taxpayers (tax agents) who are tax secret and Rules of their representation".

5. To impose control of execution of this joint order on the supervising deputy manager of Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan and the supervising vice-Minister of Finance of the Republic of Kazakhstan.

6. This joint order becomes effective from the date of signing its the last of heads of state body.

Chapter 1. General provisions

1. These rules of submission by bodies of state revenues to Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan of the data which are tax secret without receipt of the written permission of the taxpayer (tax agent) and confidential information (further - Rules) are developed according to the subitem 3) of Item 3 of article 19 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" (further – the Code), the subitem 4) of Item 3 of article 30 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) and establish procedure for representation by Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further – Committee) the information about taxpayers (tax agents) who are tax secret without receipt of the written permission of the taxpayer (tax agent) and confidential information, received by bodies of state revenues according to the customs legislation of the Eurasian Economic Union (further – EEU), international treaties of the Republic of Kazakhstan, customs and other legislation of the Republic of Kazakhstan (further - Data), in Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan (further – Bureau).

2. Data are represented to the officials of Bureau included in the list of the officials having access to Data according to the paragraph the second the subitem 4) of Item 3 of article 30 of the Tax Code.

3. Provision of Data is performed by integration between information system (further – IS) Committee and the integrated information system "E-statistics" of Bureau (further – IIS "E-statistics") by means of lock of "the electronic government" (further – ShEP 2.0) in the asynchronous mode of "automatic updating".

In the presence of the facts of violations the analysis for identification and elimination of the reasons is performed by the IS administrators of Committee, IIS "E-statistics" and ShEP 2.0.

4. Fixing of all temporary parameters in the course of transfer of Data is made on time of the city of Astana.

5. Until realization of integration interaction of the Data, are submitted by Committee within agreed time frames in Bureau by means of FTP channels.

Chapter 2. Procedure for submission of the data which are tax secret without receipt of the written permission of the taxpayer (tax agent) and confidential information

Integration between IS of Committee and IIS "E-statistics" by means of ShEP 2.0 is made on weekly basis on Tuesdays by the direction of the electronic message in XML format by means of web service, with signing by the transport signature of the owner of IIS "E-statistics", at the same time business data are signed by the digital signature (further – the EDS) the owner of IS of state body with use of the registration certificate issued by National certification center of the Republic of Kazakhstan (further – NUTs RK), and intended for determination of person.

Verification of the EDS is performed according to requirements of the Rules of check of authenticity of the digital signature approved by the order of the Minister of investments and development of the Republic of Kazakhstan of December 9, 2015 No. 1187 (it is registered in the Register of state registration of regulatory legal acts at No. 12864).
