About assistance to social formation and development of youth in Ukraine

This Law determines the general beginnings of creation of organizational, social and economic, political and legal conditions of social formation and development of young citizens of Ukraine for the benefit of the personality, societies and the states, the main directions of realization of the state youth policy in Ukraine concerning social formation and development of youth.

Article 1. Determination of terms

In this Law the terms below are used in the following value:

the youth, young citizens are citizens of Ukraine aged from 14 up to 35 years;

minors are citizens aged up to 18 years;

social formation of youth - process of versatile inclusion of youth in activity of society as systems, her perception as element of this system;

the first workplace - place of employment of young citizens after the termination of any organization of education or the termination of training in it, completion of professional training and retraining, and also after dismissal from compulsory military service or alternative (not military) service;

the youth centers of work - specialized public institutions which are created for the purpose of the solution of questions of employment of youth, ensuring its employment in non-study time, assistance to development of youth initiatives in the labor sphere, retraining and advanced training of youth;

young family - married couple in which the age of the husband and wife does not exceed 35 years, or incomplete family, in which mother (father) aged up to 35 years;

the centers of social services for family, children and youth - the special facilities rendering social services to families, the children and youth who are in difficult vital circumstances and needing assistance;

youth public organizations - associations of citizens aged from 14 up to 35 years which purpose are implementation and protection of the rights and freedoms and satisfaction of political, economic, social, cultural and other common interests.

youth labor groups - the temporary forming created for the purpose of ensuring secondary employment of youth in non-study time.

Article 2. Principles of social formation and development of youth

Social formation and development of youth are based on the following basic principles:

respect for universal values, human rights and people, historical, cultural, national peculiarities of Ukraine, its nature;

direct participation of youth in forming and the realization of policy and programs concerning society in general and youth in particular;

accounting of needs of youth, correlation of their realization with economic opportunities of the state;

availability to each young citizen of social services and equality of legal guarantees;

responsibility of the state for creation of conditions for self-development and self-realization of youth;

unities of efforts of the state, all sectors of society, political and public organizations, companies, organizations, organizations and citizens in social formation and development of youth;

responsibility of each young citizen to society and state for observance of the Constitution of Ukraine, legislation of Ukraine.

Article 3. Legislation on assistance to social formation and development of youth

The legislation of Ukraine on assistance to social formation and development of youth is based on the Constitution of Ukraine and consists of this Law, the Law of Ukraine on the Nation-wide program of support of youth for the corresponding years and other regulatory legal acts.

If the international treaty which consent to be bound is this the Verkhovna Rada of Ukraine establishes other rules, than those which are provided by this Law then are applied rules of the international treaty.

Article 4. Competence of executive bodies and local government bodies of the sphere of social formation and development of youth

The coordinating role on carrying out state policy in the sphere of social formation and development of youth is performed by the central executive body providing forming of state policy in the sphere of youth, physical culture and sport.

The Council of Ministers of the Autonomous Republic of Crimea, local executive bodies form in the structure relevant organs on realization of the state youth policy.

The central executive body providing forming of state policy in the sphere of youth of physical culture and sport together with other executive bodies develops, and the Cabinet of Ministers of Ukraine approves social norms and standard rates on social formation and development of youth which observance and accomplishment is obligatory for executive bodies, local government bodies, associations of citizens, and also the companies, organizations and the organizations irrespective of patterns of ownership, the physical persons using wage labor.

Article 5. Financing of actions for social formation and development of youth

Financing of actions for social formation and development of youth is performed at the expense of means state and local budgets, other sources which are not forbidden by the legislation.

The Verkhovna Rada of Ukraine in case of approval of the Government budget of Ukraine provides in it funds for social formation and development of youth. Manager of these means is the central executive body providing forming of state policy in the sphere of youth, physical culture and sport.

Local government bodies in case of approval of local budgets provide expenses on implementation of actions for social formation and development of youth.

In state and local budgets according to the legislation target funds for implementation of the youth and children's programs promoting social formation and development of youth are provided.

Article 6. The centers of social services for family, children and youth

For the purpose of support of social formation and development of youth the centers of social services for family, children and youth and their specialized forming are formed.

Article 7. Work of youth

The state guarantees to able-bodied youth right to work, equal with other citizens. Features of work of minors are established by the legislation.

The state provides to able-bodied youth provision of the first workplace for the term of at least two years after the termination or the termination of training in organizations of general average, professional (professional), professional prehigher and higher education, completion of professional training and retraining, and also after dismissal from conscription military or alternative (not military) service.
