About approval of approval procedures on import from abroad radio-electronic means and the radiating devices of special purpose and import from abroad, acquisitions, installation and operation of radio-electronic means and the radiating devices of special purpose

According to part one of article 5 of the Law of Ukraine "About electronic communications" the Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Approval procedure on import from abroad radio-electronic means and the radiating devices of special purpose;

Procedure for import from abroad, acquisitions, installation and operation of radio-electronic means and the radiating devices of special purpose.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

3. This resolution becomes effective from the date of its publication.

Approval procedure on import from abroad radio-electronic means and the radiating devices of special purpose

1. This Procedure determines the procedure of issue of the import permit of radio-electronic means and the radiating devices of special purpose for the omission through customs border of Ukraine and customs clearance from abroad (further - permission).

2. Permission is issued by the General Staff of Armed Forces in form according to appendix 1 and according to the list according to appendix 2.

3. The radio-frequency body of the special user of radio-frequency range of Ukraine who plans or for whom import is planned for the territory of Ukraine of radio-electronic means and radiating devices of special purpose from abroad (further - the applicant) files in the General Staff of Armed Forces petition for issue of permission in form according to appendix 3.

The application is submitted in paper or electronic form using means of the qualified digital signature.

Are enclosed to the application:

copy of the certificate on state registration of the subject of managing;

technical characteristics of the equipment (belonging to radio technologies, range of working frequencies, capacity of the transmitter, class of radiation and another);

copy of the document on equipment compliance.

In case of need directory materials (the copy of agreements (contracts), invoices) in which the name of the equipment, code according to UKTVED, quantity, the purpose and term of import, the producer, the country of the producer and the country from which territory the equipment is imported are provided can be enclosed to the application).

4. The statement for issue of permission is registered in the General Staff of Armed Forces in day of its receipt. After receipt the statement for issue of permission is checked for compliance to requirements of this Procedure. Also availability of the declared type of radio-electronic means and the radiating devices of special purpose in the register of radio-electronic means and the radiating devices of special purpose is checked.

5. Issue of permission or decision making about refusal in its issue is performed within ten working days from the date of receipt of the statement for issue of permission.

6. The refusal in issue of permission and its cancellation is performed according to requirements of article 4-1 of the Law of Ukraine "About authorization system in the field of economic activity".

7. The General Staff of Armed Forces introduces on the single state information web portal "Edinoye Okno Dlya Mezhdunarodnoy Torgovli" in the form of electronic documents with imposing of the qualified digital signature the issued import permits of radio-electronic means and the radiating devices of special purpose from abroad in day of issue of such permissions.

Release of radio-electronic means and the radiating devices of special purpose in the corresponding customs regime which allows to apply them on customs area of Ukraine is performed by customs authority based on import permits from abroad of the radio-electronic means and the radiating devices of special purpose received from the General Staff of Armed Forces with use of the mechanism of "single window" according to the Customs code of Ukraine.

8. Entering of any changes into the permissions issued to the applicant is not allowed.

9. Issue of permission is not allowed if radio-electronic means and the radiating devices of special purpose have origin from the country recognized by the state invader according to the law and/or recognized by the state aggressor concerning Ukraine according to the legislation or are imported from the territory of the state invader (aggressor) and/or from temporarily occupied territory of Ukraine, certain that according to the law.

Procedure for import from abroad, acquisitions, installation and operation of radio-electronic means and the radiating devices of special purpose

1. This Procedure determines the import mechanism from abroad, acquisitions, installation and operation of radio-electronic means and the radiating devices of special purpose by special users of radio-frequency range (further - the special user).

2. Action of this Procedure extends to special users, and also to subjects of managing in the part concerning import of radio-electronic means and the radiating devices of special purpose for the benefit of special users.

3. Import from abroad of radio-electronic means and the radiating devices of special purpose is performed based on the import permit of radio-electronic means and the radiating devices of special purpose from abroad.

4. Details of the import permit of radio-electronic means and the radiating devices of special purpose are specified in the preliminary customs declaration.

5. Acquisition, installation and operation of radio-electronic means and the radiating devices of special purpose by special users is performed under condition:

1) availability of this kind of radio-electronic means and the radiating devices of special purpose in the register of radio-electronic means and the radiating devices of special purpose;

2) availability of confirmation of the General Staff of Armed Forces about accessory of radio-electronic means or the radiating device of special purpose to allowed for use in the territory of Ukraine by special users;
