About stabilization funds of goods

Based on subitem 1.7 of Item 1 of article 6 of the Law of the Republic of Belarus of January 8, 2014 "About state regulation of trade and public catering" and for the purpose of uninterrupted providing the consumer market with goods the Council of Ministers of the Republic of Belarus DECIDES: No. 128-Z

1. Determine that regional executive committees and the Minsk Gorispolkom annually provide forming in the territory of the corresponding administrative and territorial units and use of stabilization funds of goods which production has seasonal nature * or inventories of which need to be created taking into account ensuring balance of the consumer market (further if other is not established, - respectively stabilization funds and goods).

2. Approve Regulations on procedure for forming and use of stabilization funds of goods it (is applied).

3. Assign:

coordination of work on forming and use of stabilization funds - on the Ministry of anti-monopoly regulation and trade and the Ministry of Agriculture and Food;

control over the implementation of this resolution regarding providing the consumer market with goods during the interseasonal period - on regional executive committees and the Minsk Gorispolkom.

4. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of July 20, 2016 No. 571 "About creation in the Republic of Belarus of stabilization funds (inventories) of the food products realized in the territory of the republic";

subitem 1.86 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of January 12, 2017 No. 22 "About modification and amendments in some resolutions of Council of Ministers of the Republic of Belarus, recognition voided separate the resolution and structural element of the resolution of Council of Ministers of the Republic of Belarus".

5. The delivery agreements of goods from stabilization funds signed before entry into force of this resolution are subject to reduction in compliance with this resolution till November 15, 2022.

6. This resolution becomes effective after its official publication.

Regulations on procedure for forming and use of stabilization funds of goods

1. This Provision determines procedure for forming and use of stabilization funds.

2. The ministry of anti-monopoly regulation and trade annually till April 1 determines and sends to the Ministry of Agriculture and Food, regional executive committees and the Minsk Gorispolkom information on the required amounts of stabilization funds (including by areas and Minsk) according to the nomenclature of the goods calculated based on statistical information on sale of separate goods by the organizations of trade and objects of public catering for the previous three years.

3. The Ministry of Agriculture and Food annually till August 1 sends to the Minsk Gorispolkom the list of the largest producers of goods offered by regional executive committees for forming of stabilization fund of Minsk.

4. Regional executive committees and Minsk Gorispolkom annually:

4.1. till October 1:

establish the amounts of stabilization funds for the nomenclature of goods calculated according to Item 2 this provision;

establish the list of the subjects of managing performing storage of goods from stabilization funds * with indication of storage amounts according to the nomenclature of goods;

approve schedules of monthly use of amounts of stabilization funds during the interseasonal period ** (further - schedules) according to the nomenclature of goods and provide observance of schedules;

* The subjects of managing performing storage of goods from stabilization funds for the purposes of this provision are understood as producers of goods, subjects of managing which acquired goods at producers, the populations for forming of stabilization funds which are performing storage of these goods or signed agreements on transfer of goods on storage.

** The interseasonal period on fresh potatoes food, carrots the dining room, beet table is estimated from December 1 to May 31 inclusive, on fresh white cabbage, onion, apples - from December 1 to April 30 inclusive.

4.2. till December 1 provide laying of goods in stabilization funds according to the amounts established according to the paragraph the second subitem 4.1 of this Item.

5. The subjects of managing performing storage of goods from stabilization funds provide storage of such goods in storages in which there is technical capability for maintenance of conditions for their storage conforming to requirements of technical regulatory legal acts, obligatory for observance.

6. Goods are implemented from stabilization funds:

for implementation of retail trade, public catering, and also to state-financed organizations for catering services;

the subjects of managing performing storage of goods from stabilization funds when implementing of retail trade, public catering by them.

In case of sales reduction of goods from stabilization funds in comparison with planned in schedules their realization in coordination with regional executive committees and the Minsk Gorispolkom on other purposes is allowed.

In case of sales of goods from stabilization funds in the amounts exceeding planned in schedules by regional executive committees and the Minsk Gorispolkom provide completion of stabilization funds.

7. Delivery of goods from stabilization funds to the purposes specified in the paragraph the second to part one of Item 6 of this provision is performed under the delivery agreement of goods from stabilization funds (further - the agreement) which essential conditions, in addition to the conditions established by the legislation are:

amount and nomenclature of goods;

price of goods;

purpose of purchase of goods;

schedule;

responsibility for violation of the schedule in the form of penalty in the amount of at least ten percent of cost of the undersupplied (not chosen) goods.

The approximate agreement is defined by the Ministry of anti-monopoly regulation and trade together with the Ministry of Agriculture and Food.

8. The subjects of managing performing storage of goods from stabilization funds and the subjects of managing performing retail trade, public catering annually till November 15 sign (or prolong acting) agreements. Within five working days after the conclusion of the agreement the subjects of managing performing storage of goods from stabilization funds send to regional executive committees, the Minsk Gorispolkom information on the signed agreement with indication of the name of the subject of managing with which the agreement, amount and the nomenclature of goods is signed.
