Chapter 1. General provisions

Article 1. Purpose and scope of this Law

The purpose of this Law is regulation of the relations in the field of electronic commerce.

Operation of this Law does not extend on:

the public procurements of goods (works, services) performed according to the legislation on public procurements;

the transactions made at the exchanges having licenses for exchange activities.

Article 2. Legislation on electronic commerce

The legislation on electronic commerce consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about electronic commerce then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

digital products - electronic copies of intellectual property items (digital goods), and also making in the electronic information circle of certain actions or implementation of the certain activities which do not have material result, including service in acquisition and subscription to services of "cloud technologies" (digital services);

electronic trading platform - the information system allowing to perform purchase and sale of goods (works, services) remotely;

the operator of electronic trading platform - the legal entity rendering services of electronic trading platform to participants of electronic commerce;

electronic commerce - purchase and sale of goods (works, services) according to the agreement signed through electronic trading platform with use of information systems within business activity;

the operator of electronic commerce - the legal entity rendering the services connected with turnover of electronic documents and electronic messages in electronic commerce;

subjects of electronic commerce are participants of electronic commerce and (or) operators of electronic commerce.

Article 4. Basic principles of electronic commerce

The basic principles of electronic commerce are:

freedom of implementation of business activity in the field of electronic commerce;

voluntariness of the conclusion of agreements in electronic commerce;

equality of conditions of participation in electronic commerce;

protection of the rights and legitimate interests of subjects of electronic commerce;

ensuring proper goods quality (works, services);

openness and transparency of processes in electronic commerce;

ensuring information security in electronic commerce.

Chapter 2. State regulation in the field of electronic commerce

Article 5. The main directions of state policy in the field of electronic commerce

The main directions of state policy in the field of electronic commerce are:

support and stimulation of the business activity performed in the field of electronic commerce;

creation of conditions for investment attraction, modern technologies and the equipment in the business activity performed in the field of electronic commerce;

creation of the favorable circle for development of electronic commerce, forming of necessary technical and logistic infrastructure;

ensuring protection of the rights and legitimate interests of subjects of electronic commerce;

creation of necessary conditions for competitive environment in the field of electronic commerce;

ensuring subjects of business activity with the legal, economic, statistical, production and technology, scientific and technical and other information necessary for their activities in the field of electronic commerce;

stimulation of scientific and technical researches, preparation, retraining of personnel in the field of electronic commerce and increase in their qualification;

implementation of international cooperation in the field of electronic commerce.

Article 6. Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of electronic commerce

Cabinet of Ministers of the Republic of Uzbekistan:

provides realization of single state policy in the field of electronic commerce;

claims and implements state programs in the field of electronic commerce;

coordinates activities of state bodies in the field of electronic commerce;

adopts within the powers regulatory legal acts in the field of electronic commerce;

approves the inventory (works, services) withdrawn from circulation or limited in turnover in case of realization in electronic commerce;

provides international cooperation in the field of electronic commerce.

The Cabinet of Ministers of the Republic of Uzbekistan can perform also other powers according to the legislation.

Article 7. Powers of the National agency of perspective projects of the Republic of Uzbekistan in the field of electronic commerce

Authorized state body in the field of electronic commerce is the National agency of perspective projects of the Republic of Uzbekistan (further - authorized state body).

Authorized state body:

performs regulation in the field of electronic commerce and implements state policy in the field;

participates in forming and implementation of state programs in the field of electronic commerce;

together with other interested state bodies and other organizations within the competence develops and approves standards, regulations and rules of electronic commerce;

develops offers on creation of conditions for development of electronic commerce;

takes measures for protection of the rights and legitimate interests of subjects of electronic commerce;

participates in enhancement and ensuring implementation of the legislation on electronic commerce;

will organize researches in the field of electronic commerce and monitoring of execution of requirements of regulatory legal acts in the field;

gives support in implementation of information systems and resources to the area of electronic commerce;

renders development assistance of the logistic infrastructure servicing subjects of electronic commerce;

together with the interested organizations participates in implementation of effective methods and electronic payment systems in the field of electronic commerce;

will organize promotion and promoting of electronic commerce among the population and subjects of entrepreneurship.

The authorized state body can perform also other powers according to the legislation.

Chapter 3. Subjects of electronic commerce
