1. Approve:

Regulations on procedure for filling, issue and accounting of policies of compulsory medical insurance according to appendix No. 1;

Regulations on control of payment of fees of compulsory medical insurance in the form of fixed amount according to appendix No. 2.

2. The national company of medical insurance to take necessary measures for ensuring the corresponding execution of requirements of the specified provisions.

Regulations on procedure for filling, issue and accounting of policies of compulsory medical insurance

I. General provisions

1. The regulations on procedure for filling, issue and accounting of policies of compulsory medical insurance (further - provision) are developed based on the Law on compulsory medical insurance No. 1585-XIII of February 27, 1998. (The official monitor of the Republic of Moldova, 1998, Art. No. 38-39, 280), the Law on the size, procedure and payment due dates of fees of compulsory medical insurance of N1593-XV of December 26, 2002. "About some measures for implementation of compulsory medical insurance" (The official monitor of the Republic of Moldova, 2002, Art. 2. The policy of compulsory medical insurance (further - the insurance policy) is issued to each person insured by the National company of medical insurance (further - NMSK), as a rule, through the territorial agencies (further - the agencies).

3. Insured person shall keep the insurance policy. Based on the effective insurance policy person uses in full the medical services provided by the Single program of compulsory medical insurance (further - the single program) and the provided services on rendering medical services in the Republic of Moldova which signed contracts with NMSK.

4. The effective insurance policy is:

a) for insured person - confirmation of the status of insured person and guarantee of receipt of the medical services provided by the single program;

b) for the supplier of medical services who signed the contract with NMSK - the basis for rendering medical services to insured persons on the conditions provided by the single program, methodological regulations of its application and the signed agreement;

c) for NMSK - method of accounting of insured persons and the effective organization of work with these persons.

4-1. The policies of facultative health care insurance acquired by foreign citizens in the territory of the Republic of Moldova before receipt of the right to temporary stay can be used by them within the term specified in them without obligation of contributing compulsory medical insurance in fixed amount.

4-2. The foreign citizens who received the status of the working person after acquisition of the policy of facultative health care insurance in the territory of the Republic of Moldova for receipt of the right to temporary stay shall not pay fee of compulsory medical insurance in the form of percentage payroll contribution and other remunerations for validity of the policy of facultative health care insurance. In this case the contributions which are subject to payment by the employer for insurance of persons stated above also shall not be assessed.

II. Issue of the insurance policy

5. The insurance policy is issued depending on belonging of insured person to one of the following categories:

a) persons working according to the individual employment contract, irrespective of employment duration and payment method of work (further - the working persons);

b) the unemployed persons insured at the expense of means of the government budget according to the legislation;

c) the unemployed persons insured in individual procedure according to the legislation, including public notaries, legal executives and lawyers, irrespective of form of business of activities, obtained the license in the procedure established by the law.

6. In case of belonging of person at the same time to several categories of payers of insurance premiums the insurance policy is issued in the following procedure:

"insured at the expense of means of the government budget" and "working" - the insurance policy is issued to person as "working";

"insured at the expense of means of the government budget" and "the unemployed person insured in individual procedure" the insurance policy is issued to person as "to the unemployed person insured in individual procedure", except for pensioners or persons with the heavy, expressed and average extent of restriction of opportunities being owners of agricultural purpose, except for gardens and vegerable-growing plots of lands, founders of sole proprietor companies or owners of entrepreneurial patents;

"working" and "the unemployed person insured in individual procedure" - the insurance policy is issued to person as "working";
