About features of legal regulation in the field of use of atomic energy in the territory of the Zaporizhia region

According to part 2 of article 31 of the Federal constitutional Law of October 4, 2022 "About acceptance to the Russian Federation of the Zaporizhia region and education as a part of the Russian Federation of the new subject - the Zaporizhia region" I decide No. 7-FKZ:

1. Allocate "The Operating Organization by the Zaporizhia NPP" joint-stock company with the status of the operating organization in the field of use of atomic energy which performs by own forces or with involvement of other organizations activities for operation and conclusion from operation of subjects to use of atomic energy of the Zaporizhia nuclear power plant.

2. Determine that:

a) permissions (license) for the right of conducting works in the field of use of atomic energy issued concerning the Zaporizhia nuclear power plant till September 30, 2022 continue to be effective before issue of permissions (licenses) in accordance with the legislation of the Russian Federation in the field of use of atomic energy taking into account the features provided by the subitem "e" of Item 3 of this Decree;

b) the permissions to the right of conducting works in the field of use of atomic energy issued to employees of the Zaporizhia nuclear power plant till September 30, 2022 continue to be effective before issue of permissions in accordance with the legislation of the Russian Federation in the field of use of atomic energy taking into account the features provided by the subitem "e" of Item 3 of this Decree.

3. To the government of the Russian Federation:

a) provide acceptance in federal property of subjects to use of atomic energy of the Zaporizhia nuclear power plant and other property necessary for implementation of its activities;

b) take the measures directed to creation of the federal state unitary enterprise "Zaporizhia NPP" for the purpose of safety of subjects to use of atomic energy of the Zaporizhia nuclear power plant;

c) provide fixing on the right of economic maintaining to the federal state unitary enterprise "Zaporizhia NPP" of the property specified in the subitem "an" of this Item;

d) determine for the period till January 1, 2028 features of use by "The Operating Organization by the Zaporizhia NPP" joint-stock company of the financial, material and other resources necessary for safety of nuclear installations, radiation sources, Items of storage of nuclear materials and radioactive materials, Items of storage, storages of radioactive waste and the proper treatment of nuclear materials and radioactive materials;

e) determine for the period till January 1, 2028 features of the organization and implementation of federal state supervision in the field of use of atomic energy and industrial safety in respect of the Zaporizhia nuclear power plant, including features of carrying out by authorized body of state regulation of safety of control (supervising) actions, safety examinations (examination of reasons for safety), examinations of industrial safety;

e) determine for the period till January 1, 2028 features of issue of state regulation of safety by authorized body of permissions (licenses) for the right of conducting works in the field of use of atomic energy in respect of the Zaporizhia nuclear power plant, permissions to the right of conducting works in the field of use of atomic energy to employees of the Zaporizhia nuclear power plant and cancellation (cancellation) of such permissions (licenses);

g) determine for the period till January 1, 2028 features of state regulation of safety when using atomic energy and state regulation of industrial safety in respect of the Zaporizhia nuclear power plant, including financial provision of authorized body of state regulation of safety;

h) provide issue of permissions (licenses) for the right of conducting works in the field of use of atomic energy in respect of the Zaporizhia nuclear power plant, permissions to the right of conducting works in the field of use of atomic energy to employees of the Zaporizhia nuclear power plant.

4. This Decree becomes effective from the date of its signing.
