About cooperation of the State Parties of the Commonwealth of Independent States in fight against human trafficking, bodies and tissues of the person
The State Parties of the Commonwealth of Independent States on behalf of the governments (further - the Parties),
being concerned by scales and tendencies of development of human trafficking, bodies and tissues of the person, especially in its organized forms,
proceeding from the aspiration to provide reliable protection against infringement of life and health, the rights and freedoms, honor and advantage of the person, first of all women and children, interests of society and state, and also creation of effective mechanisms of fight against these phenomena,
in view of provisions of the United Nations Convention Against Transnational Organized Crime of November 15, 2000 and supplementing its Protocol on the prevention and suppression of human trafficking, especially with women and children, and punishment for it of November 15, 2000 and the Protocol against smuggling of migrants by land, to the sea and air of November 15, 2000,
being guided by the conventional principles and rules of international law, agreed as follows:
For the purposes of this agreement the following terms are used:
human trafficking - the recruitment performed for the purpose of operation, transportation, transfer, concealment or receipt of people by threat of force or its application or other forms of coercion, stealing, fraud, deception, authority misuse or vulnerability of provision or way of bribery, in payment type or benefits, for receipt of consent of person controlling other person. Operation includes, at least, operation of prostitution of other persons or other forms of sexual exploitation, forced labor or the services, slavery or customs similar to slavery, servile status or extraction of bodies and tissues of the person for the purpose of their sale;
children are persons who did not reach 18-year age;
body - the part of organism representing evolutionarily developed complex of fabrics united by general function, the structural organization and development;
fabric - system of the cages and noncellular structures united by general function, structure and (or) origin.
1. The purposes of this agreement are:
development of the approved strategy and acceptance of complex joint efforts of legal, social and economic, information and other nature in fight against human trafficking, liquidations of the reasons and conditions promoting its emergence, and also protection of the victims of human trafficking and their rehabilitation;
combination of efforts of all state bodies, public and other organizations, and also citizens for achievement of the most effective results in counteraction to human trafficking, especially women and children.
2. The parties according to this agreement in case of observance of the legislation and international treaties which participants they are perform cooperation through the competent authorities in the prevention, identification, suppression and disclosure of the crimes connected with human trafficking and also protection of the victims of human trafficking, especially women and children, and their rehabilitation.
3. The list of competent authorities is determined by each Party and transferred to depositary in case of delivery of the notification on accomplishment of the interstate procedures necessary for the introduction of the Agreement to force.
Each of the Parties within a month in writing notifies depositary on changes of the list of competent authorities.
4. Territorial subdivisions of competent authorities of the Parties for the purpose of accomplishment of provisions of this agreement can come into direct working contacts according to the procedure, determined by competent authorities of the Parties.
The parties perform cooperation in the following main directions:
enhancement of the regulatory legal base of cooperation of the Parties in fight against human trafficking, harmonization of the national legal system in this area;
implementation of agreed measures for accomplishment of provisions of conventions of the UN, other international treaties which participants the Parties are, directed to fight against human trafficking;
