About approval of the Regulations on release of electronic money and implementation of payment transactions with them

According to requirements of Articles 7, of 15, of 40, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 5, 57 - 61 Laws of Ukraine "About payment services", for the purpose of enhancement of normative legal regulation of the activities connected with release of electronic money and implementation of payment transactions with them the Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on release of electronic money and implementation of payment transactions with them which is applied.

2. Recognize invalid:

1) Items 1, the 5th resolutions of Board of the National Bank of Ukraine of November 4, 2010 No. 481 "About modification of some regulatory legal acts of the National Bank of Ukraine concerning regulation of release and the address of electronic money", registered in the Ministry of Justice of Ukraine on December 24, 2010 for No. 1336/18631;

2) the resolution of Board of the National Bank of Ukraine of June 19, 2014 No. 378 "About modification of some regulatory legal acts of the National Bank of Ukraine concerning implementation of transactions with electronic money", registered in the Ministry of Justice of Ukraine on July 8, 2014 for No. 784/25561;

3) the paragraph third Item 2 of the resolution of Board of the National Bank of Ukraine of November 5, 2014 No. 705 "About implementation of transactions with use of electronic means of payment";

4) Items 1, 3, 4 resolutions of Board of the National Bank of Ukraine of July 24, 2015 No. 481 "About modification of some regulatory legal acts of the National Bank of Ukraine concerning implementation of transactions with electronic money";

5) the resolution of Board of the National Bank of Ukraine of February 10, 2016 No. 65 "About modification of the Regulations on electronic money in Ukraine";

6) the resolution of Board of the National Bank of Ukraine of July 26, 2016 No. 358 "About modification of the Regulations on electronic money in Ukraine";

7) Item 5 of the resolution of Board of the National Bank of Ukraine of September 4, 2018 No. 95 "About modification of some regulatory legal acts of the National Bank of Ukraine";

8) the resolution of Board of the National Bank of Ukraine of September 11, 2020 No. 133 "About approval of Changes in Regulations on electronic money in Ukraine";

9) the resolution of Board of the National Bank of Ukraine of April 5, 2021 No. 28 "About introduction of amendments to the resolution of Board of the National Bank of Ukraine of September 11, 2020 No. 133".

3. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.

4. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on release of electronic money and implementation of payment transactions with them

I. General provisions

1. This Provision regulates procedure for provision by issuers of electronic money of financial payment service on release of electronic money and accomplishment of payment transactions with them, including opening and servicing of e-wallets, establishes requirements to issuers of electronic money, their commercial agents, restrictions for use of electronic money, features of accomplishment of payment transactions with electronic money.

2. Terms and concepts of this Provision are used in such values:

1) release of electronic money - component of financial payment service on release of electronic money and accomplishment of payment transactions with them, including opening and servicing of e-wallets, connected with provision of electronic money, including provision of pre-paid payment instruments (prepeyd-cards) to users in exchange for cash and/or funds transferred from current/payment accounts;

2) e-wallet - accounting record of the issuer of electronic money, the commercial agent of the user of the subject of managing, the user - physical person, generated/created in processing system / software of the issuer or technological operator of payment services for accounting, storage and making of payment transactions with them;
