About procedure for enforcement of changes in the Technical regulation of the Customs union "About safety of perfumery and cosmetic products" (TR CU 009/2011)

According to Item 2 of article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 11 of appendix № 2 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Board of the Eurasian economic commission decided:

1. Determine that:

a) documents on confirmation of conformity of perfumery and cosmetic products to the mandatory requirements established by the technical regulation of the Customs union "About safety of perfumery and cosmetic products" (TR CU 009/2011) made by the Decision of the Commission of the Customs union of September 23, 2011 No. 799 (further - the technical regulation), registered till April 18, 2023, are valid before the termination of term of their action;

b) documents on state registration of perfumery and cosmetic products concerning which the Decision of Council of the Eurasian economic commission of April 15, 2022 No. 64 makes the changes leading to changes of indicators of safety, confirming compliance to the mandatory requirements established by the technical regulation, issued till April 18, 2023 are valid till April 17, 2026 inclusive;

c) when replacing the documents specified in the subitem "b" of this Item, in case, the stipulated in Item 25.1 Rules of execution of the certificate on state registration of products approved by the Decision of Board of the Eurasian economic commission of June 30, 2017 No. 80, such documents are valid till April 17, 2026 inclusive;

d) production and release into the stream of commerce on customs area of the Eurasian Economic Union of products which are object of technical regulation of the technical regulation in the presence of the documents on assessment of conformity specified in subitems "an" - "in" this Item, are allowed before the termination of effective period of such documents;

e) the product circulation, being object of technical regulation of the technical regulation, released during action of the documents on assessment of conformity specified in subitems "an" - "in" this Item, is allowed during the expiration date of these products established by the manufacturer;

e) provisions of the subitem "b" of this Item do not extend to the documents specified in the subitem "b" of Item 1 of the Decision of Board of the Eurasian economic commission of July 9, 2019 to No. 112.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.
