RESOLUTION OF THE PRESIDENT OF THE REPUBLIC OF UZBEKISTAN

About measures for enhancement of activities of service of the customer in the field of capital construction of the republic

(as amended of the Presidential decree of the Republic of Uzbekistan of 28.08.2023 No. UP-151)

For the purpose of enhancement of organizational support of activities of services of the customer in the field of capital construction under the ministries, departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent (further - services of the customer), phased transition to project management in the field of construction, improvement of quality of construction by creation of opportunity for broad attraction of private sector to construction management of the state objects, and also strengthening of responsibility of participants of process of construction:

1. Approve the offers of the Ministry of construction, the Ministry of Economic Development and reducing poverty, the Ministry of Finance, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent providing:

liquidation since January 1, 2023 of services of the customer under the Ministry of preschool education, the Ministry of national education, the Ministry of the higher and secondary vocational education, the Ministry of Health, the Ministry of Culture, the Ministry of development of sport and their regional branches, and also regional branches of service of the customer under the Ministry of housing-and-municipal servicing (further - the liquidated services of the customer) according to appendix No. 1;

determination as customers of objects on which the liquidated services of the customer carry out design and survey also building and construction works at the expense of centralized sources, according to engineering companies "Service of the Single Customer" under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent (further - engineering companies);

till January 1, 2023 change of form of business of engineering companies on the state unitary enterprise.

2. Determine that:

engineering companies are legal successors by the rights and obligations of the liquidated services of the customer;

engineering companies on heat supply objects in the form of public institution under the Ministry of Construction and Housing and Communal Services of the Republic of Karakalpakstan, head departments of construction and housing and communal services of areas, and also Head department of housing and communal services of the city of Tashkent performs functions of the customer of works on construction and reconstruction of objects of networks of heat supply in regions of the republic.

Engineering companies on repair of apartment houses in the form of public institution under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent perform functions of the customer on reconstruction and major repair of apartment houses in regions.

3. To the liquidated services of the customer:

till December 1 of the current year together with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent to provide full completion of construction works and commissioning of objects for which commissionings according to the works agreement 2022 is established;

till December 1 of the current year to provide transfer of objects with the term of commissioning according to the works agreement after December 1, 2022 which delivery in operation in the current year is not represented possible and passing for the next years, to engineering companies proceeding from territorial arrangement of objects;

perform functions of the customer, perform financing, accept and submit the corresponding reports before transfer of objects to engineering companies.

4. Create the Republican working group on coordination of work on the termination of activities of services of the customer in structure according to appendix No. 2 and determine it the main objectives:

assistance in work on transfer by the liquidated services of the customer of the obligations and objects assigned to them, and also their acceptance by engineering companies;

studying of each object having problems on commissioning or transfer of engineering company with departure on the place and taking measures to elimination of the available shortcomings;

assistance to the interested ministries and departments in implementation of departmental construction regulations in education, health cares, cultures, sport, public service and others;

ensuring development of offers on enhancement of activities of services of customers and on their basis - drafts of the relevant acts of the legislation;

ensuring transfer of buildings and constructions, inventory items of the liquidated services of the customer in the order of their founders or engineering companies.

5. Determine that since January 1, 2023 on the objects financed by development programs of social and production infrastructure and other centralized sources:

business plans of services of the customer affirm their founders (the ministries and departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent) in coordination with the Ministry of Economic Development and reducings poverty;

it is allowed to heads of services of the customer proceeding from amount of work and for the purpose of improvement of activities to change internal structure and to review the staff list;

services of the customer for the purpose of high-quality accomplishment of the tasks, including thorough training of the preliminary specifications on designing of objects, attract if necessary scientific educational institutions, non-state non-profit organizations, other organizations, in particular the foreign companies, and highly qualified and qualified specialists within expenses on their content;

position assignment and dismissal of the director and deputy directors of services of the customer are performed by the decision of the founder in coordination with the Ministry of Economic Development and reducings poverty;

directors of services of the customer report on activities of the company in accordance with the established procedure to founders and the Ministry of Economic Development and reducings poverty;

activities of services of the customer are coordinated by the Ministry of Economic Development and reducings poverty.

6. Create in structure of central office of the Ministry of Economic Development and reducing poverty the Department on coordination and monitoring of activities of services of the customer consisting of 14 established posts due to optimization of established posts of territorial head departments of the Ministry of employment and employment relationships.

To the Ministry of Economic Development and reducings poverty in two-month time to submit for approval in the Cabinet of Ministers the Program of measures for enhancement of material and technical resources of services of the customer, including implementation in their activities of modern information systems, to connection to necessary state information systems and resources.

To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent together with the Ministry of Economic Development and reducings poverty and the Ministry of construction:
