About approval of the Regulations on the status of observers and the procedure of their accreditation

(as amended on 17-09-2020)

According to the Art. 18, 22 and h (Art. 63 of the Code about elections No. 1381-XIII of November 21, 1997, with subsequent changes and amendments, the Central Election Commission DECIDES: 6)

1. Approve Regulations on the status of observers and the procedure of their accreditation according to appendix.

2. Declare invalid the Resolution of Central Election Commission "About approval of the Regulations on the status of observers" No. 590 of December 30, 2004

Regulations on the status of observers and procedure of their accreditation

I. General provisions

1. The status of observers and the procedure of their accreditation are determined by the Code about elections, this provision and other existing regulations.

2. Observers perform the activities according to the current legislation of the Republic of Moldova.

3. Observers are the persons authorized in accordance with the established procedure having the voting rights who can represent the internal, foreign or international organizations, organizations, and performing mission for observation of procedure for preparation and elections. The status of the observer is incompatible with the status of the candidate on elections, the member of the electoral body, the representative.

Authorized representatives can be accredited as national observers, only in case of their promotion by competitors on elections.

4. Observers can be:

- national citizens of the Republic of Moldova - representatives from qualified public associations of the Republic of Moldova or the representatives of competitors on elections accredited according to Code regulations on elections;

- international - the representatives of the international organizations, governments of foreign states and foreign non-governmental organizations accredited by Central Election Commission, and also the international experts in the selective sphere.

II. Procedure of accreditation of observers

5. The Central Election Commission will accredit national and international observers at Central Election Commission who can perform monitoring of the electoral process, in county electoral councils, to the polling precincts in the territory of the Republic of Moldova including created for the voters of the Republic of Moldova living in territorial administrative units of left bank of Dniester (Transnistria), in Bender's municipium and some settlements of the area Keushen and to the polling precincts created outside the Republic of Moldova.

6. Representatives of the international organizations, governments of foreign states and foreign non-governmental organizations can register in Central Election Commission in case of need the translators serving the international observers throughout their activities.

7. At the request of competitors on elections/participants of referendum county electoral council will accredit on one national observer to the polling precincts of the respective district with indication of the site in which they will be accredited.

County electoral council accredits also observers from qualified public associations of the Republic of Moldova for supervision of the elections course in all territory of the respective district.

In case of carrying out local elections / referenda competitors on elections/participants of referendum submit applications for accreditation of observers to county electoral council of the first level. On each polling precinct there can be about one observer from competitors on elections/participants of referendum regardless of the level of council in which they were registered or the second level, depending on case.

8. Applications on accreditation as national observers are submitted in the location of Central Election Commission for accreditation in county electoral councils, to the polling precincts in the territory of the Republic of Moldova including created for the voters of the Republic of Moldova living in territorial administrative units of left bank of Dniester (Transnistria), in Bender's municipium and some settlements of the area Keushen and to the polling precincts created outside the Republic of Moldova and in the place of stay of county electoral councils for accreditation to the polling precincts of the respective district.

9. For accreditation of observers the following documents are filed:

1) in case of national observers:

a) the statement from the organization requesting accreditation of the observers, together with the list offered to accreditation of persons completed on the sample given in appendix No. 1 to this Provision;

b) public associations represent the copy of the excerpt from the State register of non-profit organizations issued not later than 6 months before date of representation;

c) ceased to be valid;

d) the copy of the existing identity document (the identity certificate or the temporary identity certificate with mark about nationality of the Republic of Moldova) each candidate;

e) the copy of the identity certificate or the valid passport (for accreditation of national observers on the polling precincts formed outside the country).

2) in case of the international observers:

a) the statement from the organization requesting accreditation of observers;

b) public associations represent copies of the charter and the registration certificate in competent authority;

c) the application form on accreditation of the international observer completed on the sample given in appendix No. 2 to the Provision. The form is filled with each candidate;

d) copy of the valid passport of the foreign citizen (travel document);

Requests with incomplete set of documents are rejected.

10. Deadline of filing of applications on accreditation as observers not later than 7 days till the election day.

11. Invitations to the international organizations, representatives of the governments of foreign countries and foreign non-governmental organizations for participation as the international experts / the international observers go Central Election Commission or by means of the Ministry of Foreign Affairs and European Integration according to the petition of Central Election Commission.

12. In the course of consideration of the applications on accreditation the Central Election Commission interacts with the Ministry of Internal Affairs, the Ministry of Foreign Affairs and European Integration, Service of information and safety, the Ministry of Justice.
