About pesticides and agrochemicals

This Law governs the legal relations connected with state registration, production, purchase, transportation, storage, trade and use of pesticides and agrochemicals, safe for health of the person and the surrounding environment, determines the rights and obligations of the companies, organizations, organizations and physical persons, and also powers of executive bodies and officials in this sphere.

Section I. General provisions

Article 1. Determination of terms

In this Law terms are applied in the following value:

pesticides - the toxic substances, their connections or mixes of substances intended for destruction, regulation and the termination of development of harmful organisms owing to which activities plants are surprised animals, people and harm is done to material values, and also rodents, weeds, wood, shrubby vegetation, the littering species of fish. the term "pesticides" also includes remedies of plants;

agrochemicals - the organic, mineral and bacterial fertilizers, chemical ameliorants, regulators of growth of plants and other substances applied to increase in fertility of soils, productivity of crops and improvement of product quality of plant origin;

technical means of use of pesticides and agrochemicals - special machines, mechanisms and devices for processing of objects pesticides and introduction of organic and mineral fertilizers;

residual quantities are content of one or several substances which are present at plants or products of plant origin, at foodstuff of animal origin, drinking water, air, the soil or at other places of the environment which presence is result of use of pesticides, including their active ingredients and metabolites, products of disintegration and/or reaction products of such substances;

regulations of application - set of requirements for use of pesticides and agrochemicals;

certification of object - documentary certification of availability of proper conditions for work with pesticides and agrochemicals;

the agrochemical passport of the parcel of land (field) - the document containing data on the agrochemical characteristic of soils and condition of their pollution by toxic substances and radionuclides;

agrochemical inspection - obligatory continuous inspection of agricultural holdings for the purpose of the state control of change of indicators of fertility and pollution of soils;

The state register of the pesticides and agrochemicals permitted to use in Ukraine (further - the State register), - the information and communication system providing collection, accumulating, protection, accounting, reflection, processing of register data and provision of register information concerning the pesticides and agrochemicals which underwent state registration and/or permitted to use in Ukraine;

placement in the market - any ownership for the purpose of realization, including the offer to realization or to any other form of transfer of property irrespective of, such realization or transfer for a fee or gratuitously, including realization, distribution and/or other forms of transfer of property, except return to the previous owner will be enabled. receipt of the certificate of the right of work with pesticides - the process organized according to the legislation on pesticides and agrochemicals which includes training in questions of safe handling of pesticides, testing, receipt of the certificate on training concerning safe handling of pesticides and filing of application on certification about the right of work with pesticides;
