About measures for project implementation "Upgrade of water supply system and road net of the city of Samarkand" with participation of Abu-Dabiysky fund of development

According to the resolution of the President of the Republic of Uzbekistan of April 2, 2019 No. PP-4256 "About measures for further expansion and strengthening of bilateral cooperation between the Republic of Uzbekistan and the United Arab Emirates" and for the purpose of upgrade of water supply and road net of the city of Samarkand, and also enhancement and increase in efficiency of city infrastructure:

1. Take into consideration that:

between the Republic of Uzbekistan and Abu-Dabiysky fund of development the loan agreement on project implementation "Upgrade of water supply system and road net of the city of Samarkand" (further - the Project) the United Arab Emirates worth 1 101 900 000 dirhams with repayment period of 17 years, including four-year grace period is signed;

the project deadline constitutes 4 years (2022 - 2026).

2. Determine that:

a) The project is financed by the borrowed funds allocated by Abu-Dabiysky fund of development;

b) the khokimiyat of the Samarkand region is the executive body responsible for target and effective use of the borrowed funds allocated by Abu-Dabiysky fund of development and also timely and high-quality project implementation;

c) return of principal debt of Abu-Dabiysky fund of development, covering of percent, service fees of loan and other expenses within the Project are performed:

regarding upgrade of water supply system - at the expense of means of Samarkand suv tajminoti LLC and the local budget of the Samarkand region;

regarding upgrade of road net - at the expense of means of the republican budget.

3. Approve:

The main indicators of the feasibility statement on the "Upgrade of Water Supply System and Road Net of the City of Samarkand" project with participation of Abu-Dabiysky fund of development according to appendix No. 1;

The forecast schedule of return of the borrowed funds of Abu-Dabiysky fund of development raised for project implementation "Upgrade of water supply system and road net of the city of Samarkand", interest payments, service fees of loan and other expenses on the Project according to appendix No. 2;

The forecast schedule of distribution of shares in covering of expenses on upgrade of water supply system at the expense of borrowed funds of Abu-Dabiysky fund of development within the "Upgrade of Water Supply System and Road Net of the City of Samarkand" project according to appendix No. 3.

4. Authorize the Minister of Finance to sign the agreement on loaning up of borrowed funds of Abu-Dabiysky fund of development regarding upgrade of water supply system with JSC Uzsuvtajminot, khokimiyat of the Samarkand region and Samarkand suv tajminoti LLC, and also to make in need of change and additions to this agreement.

5. Take into consideration that according to the Customs code of the Republic of Uzbekistan the goods imported on customs area by legal entities at the expense of loans (credits) provided by the international financial institutions and foreign government financial institutions according to international treaties of the Republic of Uzbekistan are exempted from customs duty.

Determine that the tax amount on value added formed within project implementation is paid at the expense of means of business entities, the paid amount of the value added tax is compensated to business entities at the expense of means of the republican budget.

6. Issue to the Ministry of Justice in accordance with the established procedure the legal conclusions under the loan agreement between the Republic of Uzbekistan and Abu-Dabiysky fund of development, the agreement on loaning up of borrowed funds of Abu-Dabiysky fund of development between the Ministry of Finance and according to JSC Uzsuvtajminot, khokimiyat of the Samarkand region and Samarkand suv tajminoti LLC, and also to agreements on modification and amendments in the specified agreements.

7. To the ministry of investments and foreign trade together with the Ministry of Finance in accordance with the established procedure to consider in investing programs of the Republic of Uzbekistan the funds allocated within the Project with refining and updating of their main indicators for every year.

8. To provide to khokimiyat of the Samarkand region:

in a month creation of the Project implementation team under khokimiyat of the Samarkand region in coordination with the Ministry of investments and foreign trade and the Ministry of Finance;

annual approval during project implementation of expense budget and the staff list for financing of activities of the Project implementation team in coordination with the Ministry of Finance;

regular publication without fail on the official website of khokimiyat of the Samarkand region of data on the mastered means and the achieved project deliverables;

timely allocation in accordance with the established procedure land necessary for construction of water constructions and networks;

carrying out within the Project of works on re-deployment of the real estate units belonging to physical persons and legal entities, being in places of the planned construction of facilities, and also compensation of the damage caused to owners according to requirements of the resolution of the Cabinet of Ministers of November 16, 2019 No. 911 "About additional measures for providing guarantees of the property rights of physical persons and legal entities and enhancement of procedure for seizure of land and provision of compensation".

9. To the republican headquarters on control and coordination of execution of state programs (E. T. Yuldashev) to establish constant control behind target allocation and expenditure of means within the Project, and also each half a year to enter information in Administration of the President of the Republic of Uzbekistan.

To anti-corruption agency (A. E. Burkhanov) to establish constant control behind ensuring openness and transparency in the course of target use of the funds allocated within the Project.

10. Assign the following tasks on:

khokimiyat of the Samarkand region together with the Ministry of housing-and-municipal servicing and Committee on highways - on ensuring development and conducting examination of the design estimates of objects in authorized bodies in accordance with the established procedure;

The ministry of construction - on control of high-quality accomplishment of installation and construction works in objects;

The state committee on ecology and environmental protection - on ensuring carrying out in accordance with the established procedure the state environmental assessment of the project documentation of objects, to establishment of control of observance of acts of the legislation on protection of the nature within the Project and additional landing of saplings in places of change of trees;
