About approval of Rules of passing of certification of personnel of the operating organization

1. Approve the enclosed Rules of passing of certification of personnel of the operating organization.

2. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of passing of certification of personnel of the operating organization

1. General provisions

1. These rules of passing of certification of personnel of the operating organization (further - Rules) are developed according to the Law of the Republic of Kazakhstan of April 14, 1997 "About use of atomic energy" and determine procedure and conditions of passing of certification by personnel of the operating organizations performing activities in the sphere of use of atomic energy (further - the operating organizations), when carrying out the certain types of activity listed in the state license and extend to all operating organizations.

2. Certification is carried out for the purpose of determination of compliance of personnel of post and level of professional competence of the sphere use of atomic energy.

3. Certification there undergo the categories of personnel of the operating organization performing the following work types:

1) conducting works on safe management of the division conducting activities in the sphere of use of atomic energy - the personnel of the operating organization which are directly responsible for safety in the relevant division;

2) conducting works on control of ensuring nuclear and radiation safety - the personnel performing management and control of nuclear and radiation safety;

3) implementation of daily transactions on management of the engineering procedures connected with activities in the sphere of use of atomic energy - separate categories of operational personnel of the operating organization;

4) management and conducting works on ensuring accounting and control of nuclear materials, sources of ionizing radiation, radioactive materials and waste, and also physical protection of objects and nuclear materials - the personnel providing accounting and control of nuclear materials, sources of ionizing radiation, radioactive materials and waste, and also physical protection of subjects to use of atomic energy and nuclear materials.

4. Certification of personnel, is carried out each three years, and also in case of transfer to other position or temporary replacement of the higher head or accomplishment of obligation of other worker if requirements are other than requirements for post of the worker.

5. The personnel of the operating organization for the first time appointed to position undergo certification no later than one month after appointment it to position.

6. Certification is carried out in the state, Russian or other language.

2. Certifying commission

7. For carrying out certification the order of the head of the operating organization forms certifying commission which number of members is odd and constitutes at least five people.

The certifying commission consists of the chairman, the secretary and members of the commission.

The secretary is not member of the commission and has no right to vote.

8. Working body of certifying commission is the structural division of the operating organization determined by the head of the operating organization (further - working body).

The working body performs preparation of necessary documents for certification of personnel.

9. The head operating the organizations for representation of working body issues the order which categories of the personnel which are subject to certification affirm terms and schedules of carrying out certification are established.

10. Certifying commission persons responsible for radiation and/or nuclear safety, and also the employee representative of the operating organization are included.

Certifying commission representatives of authorized body can be included.

11. The meeting of certifying commission is competent with the quorum making at least two thirds of structure of the commission.

3. Organization of preparation and carrying out certification

12. Certification includes number of consecutive stages:

preparation for carrying out certification;

testing of the personnel which are subject certifications and/or holding examinations in management;

decision of certifying commission.

13. Preparation for carrying out certification includes the following events:

preparation of necessary documents on the certified personnel according to appendix 1 to these rules;

verification of documents on the certified personnel;

explanation of the purpose and procedure for carrying out certification;

the written notice of the certified personnel of terms of carrying out certification, but no later than thirty days about day of carrying out certification.

After accomplishment of the actions provided in this Item of Rules, the working body brings idea of carrying out certification of personnel in certifying commission.

14. Certification is carried out in the presence of the certified worker.

15. The worker who is subject to certification, but being absent on reasonable excuse undergoes certification in the terms determined by the head of the operating organization for the offer by certifying commission.

16. Certification is carried out in the form of testing and/or examination on management.

Testing is held concerning the employee categories specified in Item 3 of Rules.

17. Testing is performed according to the procedure, established by the head of the operating organization.

18. Examinations in management are held by demonstration by the worker of skills and knowledge in case of bypass of workplaces of subject to use of atomic energy or with use of the full-scale exercise machine certified for specific subject to use of atomic energy.

19. Questions for testing and examinations in management are developed on the basis of job descriptions, qualification requirements, and also regulatory legal acts and international treaties ratified by the Republic of Kazakhstan in the sphere of use of atomic energy.
