1. Approve the enclosed rules of implementation of advertizing of medical services (help).

2. To provide to committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation of advertizing of medical services (help)

Chapter 1. General provisions

1. These rules of implementation of advertizing of medical services (further - Rules) are developed according to Item 1 of article 56 of the Code of the Republic of Kazakhstan of July 7, 2020 "About health of the people and health care system" (further - the Code), and determine procedure of advertizing of medical services (help).

2. In these rules the following concepts are used:

1) advertizing – the information distributed and (or) placed in any form by means of any means, intended for the uncertain group of people and designed to create or maintain interest in physical person or legal entity, goods, trademarks, works, services and to promote their realization;

2) the advertiser – the physical person or legal entity which is advertisement source for production, distribution and advertizing;

3) medical services – the actions of subjects of health care having preventive, diagnostic, medical, rehabilitation and palliative orientation in relation to the specific person;

Chapter 2. Procedure of advertizing of medical services (help)

3. Advertizing of medical services (help) is performed in the presence of the state license for the advertized type of medical activities in mass media, electronic information resources in the organizations of health care, specialized medical editions, information reference centers, scientific conferences, the symposiums, exhibitions intended for specialists with medical education, shares.

4. Advertizing in the territory of the Republic of Kazakhstan (except for periodic printing editions, Internet resources, news agencies) is performed in the Kazakh and Russian languages, and also at the discretion of the advertiser and in other languages without misstatement of the main sense of advertizing in case of the translation of its content from one language on another.

5. When advertizing medical services (help), including by means of the advertiser, the license number and the name of the body which granted the license is specified.

6. Advertizing of medical services (help) according to requirements, stipulated in Item 2 articles 56 of the Code is allowed.
