Some questions of objects of critical infrastructure

According to Article part one 8, "About critical infrastructure" the Cabinet of Ministers of Ukraine decides parts three of Article 9 and part four of article 10 of the Law of Ukraine:

Procedure for reference of objects to critical infrastructure;

list of sectors of critical infrastructure;

Technique of categorization of objects of critical infrastructure.

Procedure for reference of objects to critical infrastructure

1. This Procedure determines the mechanism of reference of objects to critical infrastructure and their categorization.

Action of this procedure does not extend on:

the banks, other objects performing activities in the markets of financial services, state regulation and supervision of which activities the National Bank exercises, payment institutes, members of payment service providers, operators of services of payment infrastructure which reference to critical infrastructures is performed according to the procedure, established by National Bank;

the objects performing activities in the markets of services, state regulation and supervision of which activities are exercised by state bodies which reference to critical infrastructure is performed according to the procedure, established by such state bodies.

2. Terms in this Procedure are used in the value given in the Law of Ukraine "About critical infrastructure".

3. Categories of criticality of objects of critical infrastructure are established according to part two of article 10 of the Law of Ukraine "About critical infrastructure".

4. Sectoral bodies in the field of protection of critical infrastructure, using the list of sectors of critical infrastructure, identify objects of critical infrastructure of the sectors (splits) of critical infrastructure.

5. Sectoral bodies in the field of protection of critical infrastructure together with the operator of infrastructure perform categorization of objects of critical infrastructure of the sectors (splits) of critical infrastructure according to the Technique of categorization of objects of the critical infrastructure approved by the resolution of the Cabinet of Ministers of Ukraine of October 9, 2020 No. 1109 "Some questions of objects of critical infrastructure" (The Official Bulletin of Ukraine, 2020, No. 93, the Art. 2994).

6. The data on objects of critical infrastructure carried to I to II, III and IV category of criticality, are entered by sectoral bodies in the field of protection of critical infrastructure to sectoral lists of objects of critical infrastructure which are constituted and kept by them.

7. Sectoral bodies in the field of protection of critical infrastructure constitute the lists of objects of critical infrastructure of the sectors (splits) of critical infrastructure carried to I, II, III and IV category of criticality.

Sectoral bodies in the field of protection of critical infrastructure represent to authorized body in the field of protection of critical infrastructure lists of objects of critical infrastructure in form according to appendix.

Sectoral bodies in the field of protection of critical infrastructure submit updated sectoral lists of objects of critical infrastructure within 10 working days from the date of introduction of changes in them.

The authorized body in the field of protection of critical infrastructure has the right to initiate carrying out repeated categorization by sectoral body of object of critical infrastructure.

8. The data on objects of critical infrastructure containing in sectoral lists of objects of critical infrastructure is information with limited access which protection is provided according to requirements of the legislation.
