About approval "Procedure for appointment, calculation, recalculation, the translation from one type on another and payment of work pensions"

For the purpose of application of the Law of the Azerbaijan Republic "About modification of the Law of the Azerbaijan Republic "About work pensions" of November 30, 2018 No. 1362-VQD" and ensuring execution of subitem 1.1.3 of the Presidential decree of the Azerbaijan Republic "About modification of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About work pensions" of March 6, 2006 No. 377" of December 21, 2018 the No. 423 Cabinet of Ministers of the Azerbaijan Republic DECIDES:

1. Approve "Procedure for appointment, calculation, recalculation, the translation from one type on another and payments of work pensions" it (is applied).

2. Change can be made to this Resolution according to the Item 2.6-1 "Regulations on Procedure for Preparation and Acceptance of Regulatory Legal Acts of Executive Bodies", No. 772 approved by the Presidential decree of the Azerbaijan Republic of August 24, 2002.

Procedure for appointment, calculation, recalculation, the translation from one type on another and payment of work pensions

1. General provisions

1.1. This Procedure is developed according to article 5.3 of the Law of the Azerbaijan Republic "About work pensions" (further - the Law) and determines procedure for appointment, calculation, recalculation, the translation from one type on another and payment of work pensions.

1.2. No. 257 is excluded according to the Resolution of the Cabinet of Ministers of the Azerbaijan Republic of 01.08.2023

1.3. Documents (data) on appointment, calculation, recalculation, the translation from one type on another and payment of work pensions in the cases provided by this Procedure after assurance the strengthened digital signature of the authorized official of the Ministry of Labour and Social Protection of the population of the Azerbaijan Republic (further - the Ministry) brings in subsystem "Pension" (further - PSP) the Centralized electronic information system of the Ministry (further - TsEIS) or through PSP notifications go.

1.4. The concepts used in this Procedure have the values determined by the Law.

2. Request for superannuation

2.1. Taking into account article 22-1.4 of the Law, superannuation insured with the pension capital registered from January 1, 2006 to July 1, 2018 in insurance part of individual personal account, and also to the military personnel and persons with the special rank equated to them in the field of provision of pensions according to article 3.3 of the Law is made in the automated procedure without their address, based on the data received from the electronic information systems or resources specified in Item 8.2 of this Procedure, and also provided by the state bodies provided by the "Rules of calculation of expenses on providing, submissions of data on the term of military service and expenses on providing" approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of August 27, 2007 No. 135. About the decision of the relevant structural division of the State Social Security Fund in subordination of the Ministry (further - Fund) about superannuation information by mail or the notification goes to these persons to one of the means of communication which are available in TsEIS (on the e-mail address or by means of SMS).

2.2. Except for persons specified in Item 2.1 of this Procedure, superannuation is made based on the written, including electronic address of persons having the right to work pension according to article 31.1 of the Law to the relevant structural division of Fund or in the DOST Centers of the Agency of steady and operational social security (further - the DOST center) in the form established by Appendix No. 1 to this Procedure from the date of emergence of this right, and taking into account Item 2.9 of this Procedure submission of the following documents is required (taking into account part 4 presents of the Procedure):

2.2.1. the copy of the identity certificate of person which is granted work pension, except for insured which are granted work pension according to article 22-1 of the Law, and persons, the stipulated in Article 9.5 Laws (and concerning foreigners and stateless persons - the copy of the allowing certificate granting the right to permanent residence in the territory of the Azerbaijan Republic);

2.2.2. in case of application of article 8.2 of the Law in addition to provided by subitem 2.2.1 of this Procedure:

1. copies of certificates of birth of children and identity certificates;

2. the statement about results of medico-social examination about establishment of disability of the child;

3. the certificate of the representative of head of the local executive authority of the respective administrative-territorial district or the local administrative-territorial district of education by the child's mother with the established disability to 8-year age;

2.2.3. in case of application of article 8.3 of the Law in addition to provided by subitem 2.2.1 of this Procedure:

1. copies of certificates of birth of children and identity certificates;

2. the certificate of the representative of head of the local executive authority of the respective administrative-territorial district or the local administrative-territorial district of education by the father (male guardian) of 5 or more children or his child with the established disability to 8-year age;

3. the copy of the death certificate of mother or the judgment about deprivation of the maternal rights;

4. the certificate of department of registration of the Ministry of Justice of the Azerbaijan Republic of not introduction of the father in the next scrap;

5. the statement about result of medico-social examination about establishment of disability of the child;

2.2.4. for superannuation on disability in addition to provided by subitem 2.2.1 of this Procedure - the statement about results of the medico-social examination which established disability of person;

2.2.5. for calculation of allowances to work pension for service length in addition to the provided subitem 2.2.1 of this Procedure (except for military personnel and persons with special rank, and also members of their family) the reference in the form established by Appendix No. 3 to this Procedure provided by the relevant state body;

2.2.6. for superannuation on the occasion of loss of the supporter in addition to provided by subitem 2.2.1 of this Procedure:

1. it is excluded;

2. the copy of the certificate of birth of child(children) of the died supporter;

3. the copy of the death certificate of the supporter (or the judgments about recognition by his missing person or dead);

4. the certificate of educational institution of day training of child(children) of the supporter aged up to 23 years;
