RESOLUTION OF THE CABINET OF MINISTERS OF THE AZERBAIJAN REPUBLIC

of March 18, 2022 No. 103

About measures for regulation of export from the territory of the country of number of the main food products which are part of the minimum consumer goods basket, and the goods used in case of their production

Due to the climate change and geopolitical processes happening recently in the world markets the strong growth of the prices of the main food products is noted, and also there are problems in logistic supply chain of these goods in the markets of neighboring countries.

For the purpose of prevention of potential negative impacts of the happening processes on supply of the population with the main food products and food security of the country, being guided by the paragraph the eighth article 119 of the Constitution of the Azerbaijan Republic, based on Item 28.5 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About approval of the Customs Code of the Azerbaijan Republic" of September 15, 2011 No. 499 and Item 1.2 of the Presidential decree of the Azerbaijan Republic "About additional measures for application of the Law of the Azerbaijan Republic "About foodstuff" of October 23, 2003 the No. 969 Cabinet of Ministers of the Azerbaijan Republic DECIDES:

1. Determine that:

1.1. export of food products which list is established by Appendix to this Resolution and the goods used in case of their production from customs area is performed based on the positive conclusion of the Ministry of Economics of the Azerbaijan Republic taking into account the reserves which are available in the country and, proceeding from the forecast in connection with providing the population with the corresponding goods during the short-term period;

1.2. release of the goods included in the list attached to this Resolution from customs area by customs authorities is performed on condition of maintenance of these goods by the positive conclusion of the Ministry of Economics of the Azerbaijan Republic;

1.3. person who addressed concerning export from the country of the goods included in the list attached to this Resolution represents together with information on type, amount of goods which wishes to take out from customs area, the country of destination, the planned export time, and also if this person is direct producer of these goods, - about production volume, to the Ministry of Economics of the Azerbaijan Republic according to article 29.1 of the Law of the Azerbaijan Republic "About administrative production" the statement constituted according to article 30 of the Law of the Azerbaijan Republic "About administrative production".

1.4. The Ministry of Economics of the Azerbaijan Republic considers the address, the stipulated in Item 1.3 presents of the Resolution, within 5 (five) working days from the date of its representation;

1.5. The Ministry of Economics of the Azerbaijan Republic represents the positive conclusion taking into account amount of the batch covered by the address and the reserves of the corresponding goods which are available in the country if negative influence of export of these goods from customs area on local deliveries is not predicted;

1.6. In case of refusal the Ministries of Economics of the Azerbaijan Republic in submission of the positive conclusion to the addressed person within 5 (five) working days the letter with motivated refusal is submitted.

2. To the Ministry of Economics of the Azerbaijan Republic and the State Customs Committee of the Azerbaijan Republic to resolve the issues following from this Resolution.

3. Part of 1 this Resolution does not extend to commodity exportation, the physical persons of the goods which are not intended for the production or commercial purposes", approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of October 14, 2013 No. 305 included in the list attached to this Resolution from customs area according to "The preferential and simplified rules of movement through customs border.

4. This Resolution is effective till December 31, 2022.
