About approval of Rules of work of institutions (companies) of restaurant economy

(as amended on 18-11-2020)

According to the resolution of the Cabinet of Ministers of Ukraine of 15.06.2006 No. 833 "About approval of the Procedure of trading activity and rules of trade servicing of the population" PRIKAZYVAYU:

1. Approve Rules of work of institutions (companies) of restaurant economy which are attached.

2. Declare invalid the order of the Ministry of external commercial relations of Ukraine of 03.07.95 No. 129 "About approval of Rules of work of catering establishments", registered in the Ministry of Justice of Ukraine 20.07.95 for No. 230/766.

Rules of work of institutions (companies) of restaurant economy

1. General provisions

1.1. These Rules regulate the main requirements concerning work of business entities (institutions, the companies) of all patterns of ownership performing activities in the territory of Ukraine in the field of restaurant economy.

1.2. In the activities business entities are guided by acts of the legislation of Ukraine which regulate activities in the field of restaurant economy.

1.3. In Rules terms in such value are used:

restaurant economy - type of economic activity of business entities on provision of services concerning requirements satisfaction of consumers in food with the organization of leisure or without it;

institution of restaurant economy - organizational structural unit in the field of restaurant economy which performs production trading activity: makes and (or) brings to readiness, sells and organizes consumption of self-produced products and purchase goods, can organize leisure of consumers;

type of institution of restaurant economy - set of general characteristic signs of production trading activity of institution of restaurant economy;

class of institution of restaurant economy - set of distinctive signs of institution of restaurant economy of certain type which characterize the level of requirements to self-produced products and purchase goods, conditions of their consumption, the organization of servicing and leisure of consumers;

engineering procedure of institution of restaurant economy set of the transactions providing production of culinary products, bakeries and flour confectionery and their sale;

self-produced products - products which are made by institutions of restaurant economy and sell as culinary products, bakeries and flour confectionery / further - products/;

food - culinary product or the foodstuff in the natural form ready to application, portsionirovanny and drawn up for giving to consumers;

the culinary product - the foodstuff (set of foodstuff) brought to culinary readiness, but can require insignificant additional processing (chilling, warming up, portsionirovaniye and registration);

culinary semifinished product - the foodstuff (set of foodstuff) kulinarno processed, but not brought to culinary readiness which is used for further production of culinary products;

culinary products - set of food, culinary products and culinary semifinished products;

bought goods - the goods bought by business entity of the sphere of restaurant economy for further resale to consumers without modification (portsionirovaniye, cutting, additional registration);

corporate food - food (culinary, flour confectionery) which is cooked in specific institution (company) of restaurant economy for original author's compounding with assignment of the brand name by it to which the right of protection of intellectual property extends;

food staples - products of vegetable, animal, mineral, synthetic or biotechnology origin which are used for production of foodstuff;

Technology documentation on dishes and products - documentation with indication of the description of engineering procedure of production, the list of the products, food staples, substances and the accompanying materials applied in the course of preparation, this about regulations of their content in final foodstuff, expiration date, storage conditions, method of realization (representation) to the consumer, quality requirements of dishes and products.

1.4. Business entities perform activities in the field of restaurant economy after their state registration in the procedure established by the legislation. Retail trade by alcoholic beverages and tobacco products in institutions (companies) of restaurant economy is performed by business entities in the presence of the corresponding licenses.

1.5. Institutions (company) of restaurant economy are divided by types: catering establishments, factories - procurement, restaurants, bars, cafe, dining rooms, snackbars, buffets, shops of culinary products, cafeterias, and restaurants and bars - also on classes (the first, the highest, luxury).

The choice like institution (company) of restaurant economy and class of restaurant or bar is performed by business entity independently taking into account requirements of the legislation of Ukraine.

Subjects of business activity in the field of restaurant economy for occupation trading activity can have also small retail retail chain stores.

1.6. Business entities in the field of restaurant economy in case of arrangement of institution (company) according to the chosen type (class) shall have necessary production, trade and household rooms, and also the equipment for preparation and sale of products.

Requirements which are imposed to production, trade and household rooms of institutions (companies) of restaurant economy, the equipment, stock, the list of services, the technology modes of production it is established by the legislation of Ukraine.

The paragraph third is excluded according to the Order of the Ministry of development of economy, trade and agricultural industry of Ukraine of 18.11.2020 No. 2362

1.7. On facade of the room of institution (company) of restaurant economy the sign with indication of its type / class/, names, names of business entity and the mode of works shall be placed.

The operating mode of institution of restaurant economy is set by the subject of managing independently, except the institutions of restaurant economy relating to utility property of the corresponding territorial communities which operating mode is set by executive bodies of village, settlement and city councils. For institution of restaurant economy which services consumers at the companies in organizations and the organizations, the operating mode is set by the subject of housekeeping by agreement with their administration.

The operating mode shall be observed by institutions (companies) of restaurant economy of all patterns of ownership.

With business entities the proper sanitary condition of production, trade and storage facilities, and also the territory, adjacent to the company, streamlining and gardening shall be provided.
