About leaving on the public civil service

For the purpose of further enhancement of procedure for passing of the public civil service I decide:

1. Approve Regulations on procedure for leaving on the public civil service of the government civil servants it (is applied).

2. Recognize invalid presidential decrees of the Republic of Belarus (appendix).

3. This Decree becomes effective in the following procedure:

Items 2-6, 9, the 11 and 12 appendices - since January 1, 2023;

other provisions of this Decree - after its official publication also extend the action to the relations which arose since September 1, 2022.

Regulations on procedure for leaving on the public civil service of the government civil servants

1. This Provision determines procedure for leaving on the public civil service (further – civil service) the government civil servants (further, unless otherwise specified, – civil servants) who reached age limit of stay on civil service (further – age limit).

2. Leaving on civil service of the civil servants who reached age limit is performed in the following procedure:

the civil servants holding the highest state positions of the Republic of Belarus, civil positions included in the personnel register of the Head of state of the Republic of Belarus, appointment to which is performed by the President of the Republic of Belarus, – according to the decision of the President of the Republic of Belarus;

the civil servants holding the civil positions included in the personnel register of the Head of state of the Republic of Belarus, appointment to which is approved by the President of the Republic of Belarus, – according to the decision of state body (official) authorized on decision making about appointment to civil position (about release from civil position), with the consent of the President of the Republic of Belarus;

the vice-chairman and judges of the Constitutional Court of the Republic of Belarus, vice-chairmen and judges of the Supreme Court of the Republic of Belarus, the chief of the Secretariat of Vsebelorussky people's assembly – according to the decision of Presidium of Vsebelorussky people's assembly;

the civil servants holding the civil positions included in personnel registers of Council of Ministers of the Republic of Belarus, state bodies, subordinate (accountable) to the President of the Republic of Belarus, republican state bodies, regional, Minsk city, city (the cities of regional subordination), district executive committees, local administrations of areas in the cities (further – personnel registers of state bodies), – according to the decision of state body (official) authorized on decision making about appointment to civil position (about release from civil position).

3. Leaving on civil service of the civil servants who reached age limit and holding the civil positions included at the same time in several personnel registers of state bodies is performed according to the decision of state body (official) authorized on decision making about appointment to civil position (about release from civil position), with the consent of the head of higher state body.

4. The decision on prolongation to the civil servant of civil service over age limit (further – the decision) is made based on idea of leaving of the civil servant on civil service over age limit (further – representation).
